Ignoring jury duty in California, is it dangerous?

Jury Duty Faq

Will I get paid for jury service?
If you are employed full time, your employer must pay you your regular wages for the first five days of jury service.
I do not work full time but I still got $25 per day for my jury duty.

Also, you will probably waste more time in court if you ditch the summons than if you go.

Edit: Ok maybe it's just a few states that require your employer to pay you.

Wise up zippy, the laws cover exactly this situation. You have to prove that you DIDN'T get the notice, for things like this it's presumed that you did. Unless you can prove they have the wrong address on file and hence misaddressed the letter you're on the hook.

No the letter wasn't misaddressed. Regarding proving that i didn't get the notice. 3 weeks ago i ordered credit card replacement because i lost it. It still haven't gotten to my house, even do credit card company says they shipped it out. It's possible for mail to get lost and i am sure it happens frequently. I think i am going to call court on Monday to see if they let you out for financial hardship, which what this would be.

In California, we maximum get $15 per day :( and no, employer is not required to pay for your jury duty at all.

In my county, the website states that if you don't show up, they will reschedule and send another notice (certified perhaps, this time.)

Then they can/will impose a fine/jail time..

Probably nothing will happen especially if you live in a county with a large population. In CA they don't have the manpower to send someone after you.

Did it come in certified/registered mail? No? Then you've never received it...

And for all you taking the high and mighty route, how about you do something if you want people to do jury duty? If I'm working hourly (full time student) I will toss any kind of jury duty notice as it will cost me significant amount of money, civic duty or not. Make employers pay for you regular wage for jury duty and maybe you'll get people to show up...

Bench Warrant in most states. If you get pulled over, when they run your record, you will be arrested.

I think it's a federal crime for an employer to withhold you form jury duty. as far as pay, I'm not sure....but I would think that they still have to pay you

Most companies don't pay you when you're on jury duty, neither can they fire you while you're on jury duty. Now firing you after you're done with jury duty is another story.

I ignored a summons last year and I'm still here.

had financial reasons for not being able to go, the problem being that they only led you plead financial hardship in person, which I'd have had to take off of work to do, which was the original reason I couldn't attend jury duty in the first place.

I just threw away the letter... no sheriff at my doorstep, no fine in the mail, no warrant for my arrest.

I've never actually heard any first-hand accounts of people getting locked up for ditching jury duty.

I would honestly just go in and tell the judge you are a hardship. Bring proof of your obligations, heck I'd bring a cash flow statement, copy of bank accounts, debts, rental agreements, whatever - a note from your employer explaining that they don't pay anything. It seems if you truly have an untenable situation you can prove it and it may be a good chance the court will admire your honesty and dismiss you.

since skipping JD, I've renewed my car registration, renewed my license, and was pulled over by a cop a couple months ago who ran my license (gave me a "warning" for going 37 in a 35, lol).

edit: not that I'm advocating skipping... I was in unique circumstances and wouldn't do it again unless I absolutely had to.

Don't bullshit yourself by thinking they won't do anything. The judges take this very serious, and are prone to issue bench warrants for those who fail to appear.
This past March, I had to spend a couple of days doing court reports for my Business Law class.
Twice during those 2 days, the judge issued bench warrants for people who didn't appear and hadn't called in to postpone their duty.
In one case, this was the 2nd time the personhad skipped jury duty, and the judge ordered the Bailiff to call the Sheriff's office (the bailiff's are Sheriff's deputies) and have a car sent to pick up the missing juror. :eek:
I don't know if they ever found him or not, but I certainly wouldn't want to be that fellow.
Skipping jury duty is considered to be contempt of court...

LOL good luck with that. everytime i've had it they do a roll call and then they contact the deputy for the courthouse. About 30 min later, everyone that did not show up was escorted in by a deputy.

Nothing will happen to you, I know a few people who throw it away. I've been summoned a couple times and I've gone in and done my service. There are usually enough people who show up that they can select juries from.

I've only had to go once. I was paid $12 to sit in a room and watch soap operas all day (I wasn't called to be on a jury that day).

It was long and boring, but its something I had to do. Your job has to give you the time off for jury duty.

in NJ, the money you get for jury duty doesn't even cover the cost of parking by the courthouse.
