If you are a pedistrian on the streets....

Last night I had an interesting experience. Driving home from blockbuster (it was dark, and raining, so visibility wasn't that good) and out of no where I see this lady running across the street. I was driving 80km/hour in a 60km /hour (my normal speed) and almost hit her.

If you are jaywalking (or jay running in this case) LOOK before you run across.

This was in the middle of the street, not anywhere near a stop light.

After yelling a few choice words at her, I wondered, if I actually did hit her and quite possibly killed her, who would be at fault?

well you're an ass for driving 80 on a 60 in the rain. if you're speeding, at least do it on a good DAY and watch out for people.
 
I was under the impression that the driver is not at fault in case of accidentaly hitting a pedestrian. Granted I think I learned this watching CSI, so its quite posibly wrong. No I don't believe everything I see on TV, but this made sense. But in this case you would be at fault, due to the 80 in a 60 zone.


Plus its kinda stupid posting about how stupid someone crossing the street is, when you were speeding. I mean you can't call them stupid for not looking when crossing, if you were driving in excess of the speed limit.

80km compared to 60km isnt really THAT much of a speed difference.. its only about 11 miles an hour difference.

Regardless, yeah, dont speed. Especially if weather and road conditions arent really at their peak.
 
This reminds me of those crosswalks they have inbetween intersections on 35-40 mph, double-lane roads. With the lights and everything. But since the lights are yellow and blinking, it is up to the pedestrian to just start walking and hope traffic stops.

I will admit that, after I thought about it, I really wasn't sure exactly how many miles per hour that would be. But I assumed it had to be at least 10. And had it been daylight and clear, then i would have kept my mouth shut, although its still speeding. But it was night and raining, too fast for those conditions.
