if i run over a jaywalker, what do i get charged with?

i have right of the way, jaywalker comes out of nowhere and i have no time to react.
he gets hit and dies.

is that vehicular manslaughter?

How fat is the jaywalker in question? Because if the jaywalker was fit and beautiful you will be sent to prison and sodomized. Fattys will get you probation at worst.

Generally no charges would be filed as he was commiting a crime when you hit him. That's the way it is in my state. It's frequently reported "pedestrian struck and killed, no charges filed".

Now if you killed him while breaking some traffic law then they might go the vehicular manslaughter or just reckless driving.

Personally I jaywalk. BUT there isn't as many people around here.. One of the few times I was using a crosswalk some bitch lightly tapped me with her caddy. Intersections too much can happen IMO, right turns, left turns, right on red, assholes. But when you're crossing like a 2 lane road, I'd rather just watch traffic and walk fast to the other side.

I don't think you will be penalized, but your insurance premiums should definitely go up since a police report is filed.

Depends on what you were doing behind the wheel. If it can be proved that you were in any way driving in a reckless manner, anything from negligence to vehicular manslaughter depending on the situation. If it can't be proved that YOU did anything wrong, nothing.

It's not jaywalking unless you interfere with the normal flow of traffic. You do not have to use crosswalks.

The law is a little hazy, but in practice the person who is jaywalking has the right of way even though he is committing a unlawful act. It's only when the driver has no time to yield to the pedestrian that you will get off free, and that is decided mostly on the police report. The car is obviously larger and faster than any person, so given the chance to yield, you save another dumb person's life.

Manslaughter charges really depend on how careless or malice the driver is. I would imagine you could be charged with reckless endangerment if you had ample time to yield, excessive speeding, or disobeying a traffic signal. It's only in extreme cases like if you were drunk, street racing, or in a fit of road rage and intentionally wanted to hurt someone, than you can get hit with manslaughter.

My pop worked in police as well as auto insurance. He told me a little tip should I need to prove I was involuntarily distracted such as not seeing a pedestrian and be able to react in time.

Tell the police you were sneezing.

Since it's involuntary, and you close your eyes when you sneeze you can't be held liable for anything caused by failure to react quickly. You were distracted but it was totally beyond your control.
