If I point a gun at someone and they have a heartattack, is it considered murder?

You drive the getaway car in a bank robbery and stay in the car. During the robbery one of the other robbers kills a teller. Do you get charged with murder?

arent you an accessory to murder.....which is a murder charge, but nothing like 1st or 2nd degree?

I believe in some states that is called "Felony Murder."

Basically manslaughter. It's the same as hitting someone with a stick and they die. You didn't mean to kill them, but you did. If you fire the gun, it might be attempted murder 2.

yes, but you can never be charged as an accessory. you are charged with the underlying crime, in this case murder

I'm not a lawyer, but that sounds like something they'd call depraved indifference homicide on Law & Order.

recklessness indifference applies when injuried is caused due to gross recklessness. it may or may not apply in this case, but i would think it doesnt apply.

Like I said, I'm not a lawyer... but in the situation described the person who pointed the gun at the other guy caused the other guy's death. I'm sure they'd find a way to charge him with something.

So you actually shot the guy and he doesn't die from the gun wound, but his mother dies from a heart attack upon hearing the news, is it murder?

Guy jumps off a building to commit suicide... gets shot by a bullet on his way down...
suicide or homocide?



homocide was ruled... so yes the guy is guilty of murder.

yeah, DAs have a good amount of leeway regarding what they want to charge. generally, they will go with the most severe charge that they have a legitimate chance in proving. In this case, there is a very wide variety of offenses they can charge
