Identity Theft, I have been had and then some

This is a strange story and funny if it didn't happen to me. The background is that somebody with the exact same name of mine ended up living next door to me in CA. I am guessing that he got some of my mail in order to secure my SSN and such, but it is still a mystery.

The first time I realized something was wrong is when I got a letter from the DMV stating that my drivers license had been suspended for non payment of child support, I have no such order. I went to the DA's office and talked with them until I was blue in the face and kept getting "its your ssn right?" and that was getting old fast. After a couple of hours I convinced them to call this persons ex wife, in Oregon, and she gave them a description and thankfully it was not me. The DA gave me a signed letter of apology (I need my liscense to be a medic) and fixed my liscense promptly. I keep that letter in my safe for future problems.

I recently checked my credit report and there are all kinds of things from Calif on it, and I left there over five years ago. There are also wrong addresses and other things.

Should I pursue this as a criminal matter? Thats what I want to do. He is obviously still using my ssn when he applies for these things or it would never end up on my report. This guy is toejamb.

 
Yes, sue him until he is bleeding money from all orifices...and is in jail...for a long, long time.

What a scheme. You would think someone from the postal office would have sniffed this out(if they would ever do something like that).

This sucks big time.
 
Another suckage point, and why I posted this, is I went to renew my license today (in Nevada) and they said that they cant because it has been suspended or revoked in California. That loser has done it to me again and this is the LAST straw. I am thinking about flying out there and going to where he applied for credit and closing the accounts, after all, I have MY social security card and ID. I am also going to get copies of the credit applications with his writing on them and my SSN, that should be rock solid for the DA.

I am going to FUBAR this guy!

Hopefully you can sue for damages...have you talked to a lawyer yet?

PS I don't think you should fly out and close the accounts because it lends credence to the idea that they are your accounts. Catch22...
 
no credence that they were my accounts at all, his signiture will be on them, not mine. I am pretty sure that he is over ten years older than I am too, not to mention that I have been living in Nevada for the last five years. I can place myself when these "contracts" were signed.

OK I see what you mean. I would just be extry extry careful. I mean, I would imagine you would want to go up to the manager of the place and lay out your story then say they aren't my accounts I want them closed and I want a letter saying they were never my accounts or something along those lines.... you get my point I hope.

I just thought if they pulled the person into court who closed the account and asked them to point to the account holder..... they might recognize you but not the other guy.....

Beats the hell out of me obviously I'm out of my depth... definately get a lawyer....
 
sorry to hear that, you should sue him first then pursue criminal charges, that way you will get paid. If you put him in jail first he will have no money to give you if you win a lawsuit.
 
right, thats what I meant, the manager needs to be notified and he or she can take it from there. I just want to let them know that it is not me and that I want my social taken off the account NOW. I also want copies of the records. I used to work with the sheriff's dept in that county so I am sure I can get some help from some friends to show up in uniform to show how serious this is. A good friend of mine is a detective there too, I will probably have him along for the ride.

Agreed. Get a lawyer FIRST. Follow his advice not ours, you have enough problems as it is. Save your money on the plane ticket - your going to need it for the lawyer! Good Luck!

unfortunately, I trust Lawyers as much as my ex-wife. I will be careful, I just want to get the documents that he signed that included my ssn on them. Copies are what I am talking about.

I will talk to the Marin County DA before I do this though, they may be able to get warrants for the items I am speaking about. We are on good terms and I have done alot for the sheriffs dept and the county.

Best thing you can do to end this problem is to request a new SSN from Social Security. You must document that someone is abusing your current one. I would definately pursue getting this guy in trouble if you can, but to protect yourself get a new SSN and buy a shredder for gods sake. Everyone should shred anything that has even a single line of personal information on it.

Thanks about the comments about my certs, I have not posted my CIW certs or the other mcse classed, I lose track of what I have updated. I have too many certs to post, kind of a problem related to my job, they always want you to learn more, and more, etc.

Sorry Jerboy, I thought that was in my quote area, I will change it, sorry.

Thanks for all the advice, I am still pissed and dont know how to handle this...
