*Update*:

Just receivved word that the car was totalled (this was expected, but it's official now). They are giving me $3850 for the car, which is ok, because I only paid $3K for the car a little over a year ago. Contemplating what to do, as the job I have I know I will lose in November, and I want to go back to school, so I'm thinking that I will buy something cheap to make it to the end of the year until I move close to a campus in which the car won't be necessary (and I'll still have my motorcycle).

This weekend I am getting rid of the Z in my sig with the cash for clunkers (dad is buying a new car) as this car has given me nothing but problems since I bought it about 2 years ago. In return, to help my wife and I out, my dad is giving me a 2004 Saturn ION with about 50,000 miles that I will give to my wife for her commute to work.

Also, the insurance company contacted me and they want to settle for the bills, pain and suffering, and lost wages.

So far my medical bills come to about $4k. Thankfully I haven't lost any wages because I have been laid off for 5 weeks from my job at Penske Logistics. I'll have to figure out what I come up with for a total amount for this ordeal.

Good luck, so far it sounds like they're being reasonable with the payout for the car. I hope it holds out for your medical bills and things too.

Yes, I went to the hospital.

If you had the above payout to spend (I don't want a car payment at this point in time), what would be some practical cars to look for? Or the best bang for the buck if you will.

As far as the car it was an '01 Malibu, and I only had liability on the car, since it was rather old. Not sure if the accident being declared her fault will help me or not (I live in TN for reference).

Also, I'm curious if anyone thinks that I should attempt to go after any type of settlement with her insurance company for the medical bills / time off from work. I've never had any experience in a legal proceeding and I'm not looking to gain financially, however, I don't want to be on the losing end of the stick. Thanks in advance.

get a lawyer. sue for pain and suffering.

this is how it typically works.

her insurance will payout 3x your medical costs.

so if cost of initial hosipital trip + followups to doctor = $10k (doesnt matter if your health insurance paid it), then her insurance will pay $30k (assuming u have any semi-good ambulance chaser lawyer.)

$10k to hospital
$10k to lawyer
$10k to you

TN state min. is 25/50.
Most health ins. companies want at least 1/3 of their costs reimbursed from a settlement.
$10K for soft-tissue (cervical/neck strain) treatment would be considered overtreatment by most auto insurance adjusters.

No. You contact yours and let them deal with the other person's insurance company. You PAY THEM to do that and they have their own ways of dealing with others. Trying to fight the other person's insurance is insane. Let the companies duke it out, its much more effective and less headache for you.

That is not what you pay for. Yes, if the other company refuses to deal with you, then you can turn to your own. He hasn't even contacted the other company so there isn't even a fight yet. BTW, how many years of experience do you have selling or dealing with insurance companies?

Is this how insurance works in other states? I have AAA here in CA and when I got t-boned I contacted them, gave them all the information, and they dealt and got the money from the other insurance company. I have no idea why anyone would ever want to do it themselves.

The new American dream, sue, sue, and sue some more. It's like welfare for the lower middle class. Why not fake a neck or back injury and go for the big payout? Or claim the accident made you impotent and collect a few more bucks? The cool thing about that is that your wife can sue for loss of use, it's the bonus round!
