I was in another wreck this week... *with pics* UPDATE!!!

I was working late Monday night and had to go to another building to restart a server at the console. There is a parking space right in front of the building that's metered. I pulled into the space and parked and was talking to my g/f on the cell when BAAAAAMMM!!! Some chick hit my jeep. I took this picture yesterday to show where I was parked...kind of weird, but there was a black jeep parked there that's not too different from mine. Link The impact pushed my jeep, while in park all the way to the yellow sign that's slightly bent.

Here are the pictures of my jeep and the damage that was done to it... Link I got a bad case of whiplash. The girl hit me with a 98-99 Honda Accord EX. I haven't gotten the police report because I got rushed to a hospital to get Xrays.

The damages are as follows, looks like the rear axel was bent, both driver-side doors will not open, the driver-side front seat broke during the impact. (where I was sitting) and the windshield was cracked upon impact.....from a REAR impact. She must have been doing 35-40mph. Any thoughts?

Also, what should I try to get from this situation? I know my jeep is going to be under-appraised and I'm going to have a hard time replacing it. My neck, back, abs, and left leg are all sore. I've never been in a wreck like this before....especially one where I was legally parked on the side of the street. Advice please. Thanks,

Edit: The reason the title says another wreck, I hit a volvo last month that tried to make a left turn from the right lane and pulled in front of me. I really wish people would start paying attention.
UPDATE!!!:: THE CHICK LAPSED ON HER INSURANCE PAYMENTS!!!! SHE WASN'T INSURED!!! ARRRGH!!!

Also, what should I try to get from this situation? I know my jeep is going to be under-appraised and I'm going to have a hard time replacing it. My neck, back, abs, and left leg are all sore. That's a given, but I was thinking about pain and suffering, and trouble for this inconvenience... I didn't know what kind of dollar figure you can put on that.

Sorry, I am not sue happy. I have been in a couple of wrecks that were not my fault. I never asked for pain and suffering. Just my car, medical and lost wages.

I'm not sue happy either, but I want to get my jeep at least replaced. I just know that the insurance companies don't like paying that kind of thing out. This event has caused me a lot of trouble because I know I'm not going to be up for the camping trip I was going to go on for Memorial Day. I won't be able to carry the equipment or take my boat out (too bumpy on the water) So they've comprimised my recreational plans. That is what angers me most... I guess things will work out when I can finally file the incident with this chick's insurance. I just have to get the police report when it posts tomorrow or the next day.

This is why I'm thankful that our Accord has FULL COVERAGE insurance (comp &amp; collision) with "loan gap" insurance.

Wow, that is a ton of damage. The Jeep is most likely totalled, since the unibody is twisted fairly badly (enough to crack the windshield).

Just get a lawyer already and he will know what to do. Here in NY state its a No Fault state so even if the girl hit you, she could sue you for damages, when it was her fault.

i know because i'm in a lawsuit thing now.

wow another accident involving a chick. what else is new.

just the other day i barely managed to avoid hitting some dumb b1tch in a jeep who was stopped halfway in my lane from the onramp because she wanted to cross straight over to the other side.

girls and common sense dont usually mix.

wow...thats kinda fvcked up. good luck to the OP. i was in rear-ender last september and still in the process of dealing with insurance company. my first lawyer couldn't get any recoveries so i ended up suing in small claims. i won that and AAA is appealling so now i got me another lawyer...so much hassel...

Just get your medical expenses,car coverage......stuff happens. Unless, you are really hurt
then sue I guess. People must assume the risk of driving, period. You may be a good driver, but
you have to think about all the dumb a$$ people out there.

Most companies are willing to give a little of something to avoid taking it to court, so if you do have some physical therapy for your neck and such, try to just get enough to cover the cost of buying a comparable vehicle.

Can you believe it??? She didn't have insurance because she lapsed on her payments!!! Should I take her to court, or should this one just be left to my uninsured motorist policy?
