So I was taking this girl home and we stopped outside her house and her dad comes up to the car and hits me.

Sure, she wasn't supposed to be outside, sure, it was after curfew, but nothing can justify him hitting me.

So, how would one ensure their ability to sue the individual?

Do I need to file a police report and press charges or can I just sue?
 
file police report. Once found guilty in criminal court, civil court is a cake walk. BTW...talk to a lawyer.

BTW....CALL POLICE ASAP! DO NOT WAIT UNTIL TOMORROW MORNING!

Suing will get you nothing (most likely)... file charges against him and get him thrown in jail. That'll teach the ass....

One note though, this will insure that his daughter won't go out with you again.

Sue..no...but the guy is not entitled to hit the boyfriend...or whatever this dude's status is...

We weren't on a date or anything, we just went to a mutual friends house.

We stopped outside her house, and out of nowhere he hit me with this toy or something.

No discussion or anything.

Like a plastic thing a kid would ride around on or something. A plastic firetruck or something, I'm not even sure it was that. I drove off before taking time to examine his weapon of choice. Hard plastic though.

Doesn't matter if I'm bleeding, which I'm not.

He assaulted a minor and given the opportunity to make him pay I will.

you have been given the oppertunity dumba$$. Call the police.

your lack of willingness to do so will suggest that you did something to provoke said attack, and/or had run-ins with the father figure before this event. Call the cops, or STFU.
 
I called police. They said they cant do report over phone, come in tommorow morning.

I did nothing to provoke the attack. He was asleep, she snuck out with no permission. We came back, stopped, and then he approached from the left side of the car and hit me, called me an asshole, I pressed gas slightly, he tried to grab key, I drove up road and stopped, she got out, I left.

First you say, he hit you. Then with a toy. Then with a firetruck. Then his daughter didn't have permission to go to this 'mutual friends' house.
