Definitely contact the D.A. Even if the D.A. can't do anything, word will get back that you're serious about this. Tell the D.A. that you'll probably have your lawyer with you when you return to court. If word gets back to the officer (and it probably would), then he'll just not show up, allowing you to win.
 
Cop is going to lie when he shows up, if you are serious about beating this you might want to get a lawyer. They violated the due process rescheduling the trial.

I have a court date scheduled for Nov 2 as well. Ticket is 80.8 in a 55 zone. I was planning on basing my defense on the fact that the Vascar numbers on the ticket don't match up. In other words, if you calculate the distance over the time, it doesn't exactly match the speed on the ticket. And since Vascar is just a fancy calculator, it was obviously malfunctioning. I think that should be enough for the ticket to be thrown out.

But this thread is making me think I should pay for a lawyer anyways. I think I can handle it, but if I lose due to something stupid, I would be pissed...

(and its often cheaper to pay a lawyer now, then pay the fine AND increased insurance costs over the upcoming years)

All his problems are solved now. That DA is going to throw this case straight out of court when he recieves your e-mail. :roll:
 
What's up with traffic court for cases like this? It's pretty much your words against the words of a cop. There's no real evidence of anything so how can guilt or innocence be determined? If it can't, isn't this going against the whole innocent until proven guilty thing?
 
Ouch. Good luck man. I have a feeling you are going to get ganged by the 3 other officers. Too bad you didn't have a friend or some witness to testify for you. I heard a tip that if you pay a lil extra than the fine, in some municipalities, the case will not be closed and sent to insurance until you cash the check they send back to you.

I heard that if you pee on the judge's face in court he has to eat the ticket in front of you and you don't have to pay anything.
 
As a fellow motorcyle rider I completey understand and I think its complete BS.. That is a motorcyclists worst nightmare.. There are a lot of haters out there especially to those of us on sport bikes....
 
You should have told the judge that you do not want to continue at a later date. Under the 6th amendment you have a right to a speedy trial. Since you have now come twice you feel your 6th admen. rights are being violated. Ask for a motion that either it goes to trial NOW or it is dismissed. If he denies it then ask for the motion to be heard on the record. That gives you great leeway for appeal.
I did this once for a no show cop as the judge was about to continue it. He was mad but dismissed it.

Correct, innocent until proven guilty, which is why he doesn't have fine or punishment against him yet. However, in a court of law, the word of a law enforcement officer can be entered as EVIDENCE. Your word is also entered as EVIDENCE. The judge then compares the EVIDENCE and decides the outcome of the case. The evidence of his word versus your word. In a court of law, that is almost always going to favor the cop not the citizen. You need to present stronger evidence in your favor over the word of the officer to not be found guilty. It's stupid how that works, I know, but that is how the system works. Which is why some areas now force cops to enter more evidence in than their word, usually a video tape of the incident. This is why if you fight it in court, go for a jury trial if your state allows it. If not, then you need to bring a lawyer. They are nifty for finding loopholes in the laws and actions of judges and cops to get people off the hook. A lawyer on your side keeps the other side on their toes because if the slip up, the lawyer will know how to fight back and make their lives miserable. Well, a good lawyer would know at least.

Even if the lawyer can't catch any mishaps, the word of the lawyer in court counts far more then the word of an average citizen for small stuff like this. Why that is the case, I don't know. It's just one of those stupid things again in our justice system's due process. If its your word against the cop, the cop wins. If it's your lawyers word against the cop... that's a whole different ball game in court.

Call your local news and try to get a investigation done on the cop, call your politicians... That kind of crap is totally unwarranted.
