i was in the train today and there was this semi-homeless looking woman being really a pain in the butt and really obnoxious...basically she was like talking to everyone in a VERY loud tone, full of expletives, and she had a stupid joke book that she kept reading for the entire time, out loud so everyone in the entire train can hear her.

Some people started telling her to shut-up, exchange words...etc, finally, one person poured their coffee on her. Not hot but she got wet. Person was gone but since then, she kept yelling, swearing, saying she was assaulted etc...but no one sympathized with her, no one cared.

what u think?
 
i think its funny. not assault. harrasment maybe...but then again she was guilty of harassment herself.

she's a homeless wacko....who cares?
 
Ok, people can be annoying, but I would never pour coffee on somebody just because they were loud. Now if you personally offended me or directed the expletives at me, I might accidentally spill whatever drink I had.
 
I would hope that spilling coffee on someone, homeless, annoying, or otherwise, wouldn't be considered assault. But then again, this is America, land of the free to sue.
 
I think this one fell through the cracks and she's crazy as sh1t. Interesting moral dilemma; on one hand she's incredibly aggravating, begging for some kind of interevention to sut her up. On the other hand, do you really want that on your concscience? "Gee, I just poured my coffee all over this poor, annoying crazy lady." Personally, I think it was wrong to do that to her.

sounds like battery, not assault. at least, for tort. for criminal, sounds like assault.
