My car's engine is having problems, so it is going up to the dealer.

I was going through my file, looking for the date that my warranty ended.

I pulled out two sales order's for my car. They don't match. One is the one I signed, the other is attached to loan info.

On September 8th, 2007, I agreed to buy the car for a certain price, and put down $2,500. I had a loan lined up, and still had a rental from the car accident (i was buying a new car because I was in an accident in which my car was totalled). The bmw salesmen said he thought he could get me a better loan, and they needed time to get the car ready. (it had just came in from a trade in).

Anyways, about a week later, the salesguy did get me a better loan through BMW. Everything was ready, and I just needed to sign. However, the salesmen was out sick, so his GM did the sale. He pulled out my file, we set everything up, etc. He said he was just going with the price the salesmen gave me, that was on my order.

I just noticed that the order the GM drew up was a different price, like $600 higher. And that's what went down on my loan. The car was about $29k. However, the receipt in which I put $2,500 down, and it had the agree price, is lower. That's the one I signed. The other one, I didn't sign.

I'm taking the orders up to the dealer with me. I think they should cut me a check for the difference.

You signing the contract to purchase the car supercedes anything else.

The contract I signed to purchase the car is for $600 less than what they filed on my loan. That's what I'm saying. The Order I signed is $600 less. The one they drew up and used for the loan, which I didn't sign, is the greater amount.

You wouldn't have the car if you didn't sign the final contract agreeing to pay X amount, at X interest rate, etc. That would be the contract that supercedes all the others.

Yea, well I'm going to see what they have to say. It's about time to trade my car in anyway.

Here's the sales order that I signed, which includes tax/title/license/down payment, and here is the one you attached to my loan. See the $647 price difference? The price I agreed to was like $28,340. The price they put was a flat $29,000. I didn't sign that sales order. I signed the one with the price I agreed to.

Now you know to watch out for this kind of shit. When I bought my truck they tried to slip in some warranty I didn't ask for. I said something about it and they said I thought you said you wanted it. They knew I didn't they are sneaky fucks. I would of walked out if I wasn't getting a good deal already.

They took off the bogus warranty.

Well, this is the one and only, otherwise reputable, bmw dealer in the area. Their service has been amazing and cordial. I'm going to be really surpised if they don't acknowledge the mistake and attempt to correct it.

What a coincidence... I've been going through my contract law part of class recently. Long story short, you're probably screwed legally.

Even so, but if I present Sales Order 1 (signed) and Sales Order 2 (unsigned) and say, hey, why did you guys up the price? I didn't sign that. How can they come out being "correct" about it without looking shady? This is one of the largest dealers in the St. Louis area, if not the biggest.
