There is a gardener i have hired every month to perform lawn mowing/gardening services at my home. he recently caused damage to my front lawn using improper treatment and now there are approx $2500 worth of damaged caused by him.. 🙁 he refuse to do anything because his business account only has so much money (less than what the damage he and his serviceman caused) Can i look to into his personal assets for recovery my damages or do i have to limit only to his business account...
?

You should consult a real lawyer, not people here on ATOT... I would think things like this would depend on local/state laws...
 
well if i wanted to, i would called a lawyer by now.. its sunday and tomm is best option. until then i am interested to know if someone has knowledge on this and give me their insight until then...

Like someone else said, it depends on how (and if) he is incorporated.

If he is an LLC, a corporation or S-corp, then he has no personal liability.

If he is a sole proprietor or a DBA (Doing Business As), then he can be personally liable.

When you pay him, how do you do it? If you pay by check is it to him personally or to his company?

ah there is my funny guy of AT.

just the lawn was not done correctly and some part of the lawn grass/tree/plants are now burned and needs to be replaced.
 
Cliffs:
Landscaper burnt lawn by over-fertilizing and also performed some shoddy work.
Want to make him pay for cost to fix yard.
What do I do?
