I JUST got my presidential alert!

"A new lawsuit filed in New York is seeking to stop the implementation of FEMA's new "Presidential Alert" messaging system, an alert used for national emergencies that can be deployed by President Trump. Plaintiffs in Manhattan are suing Mr. Trump and FEMA Administrator Brock Long, claiming the alert system is a "violation of Americans' First and Fourth Amendment rights to be free from Government-compelled listening, as well as warrantless, non-consensual trespass into and seizure of their cellular devices."

Plaintiffs compare the alert system to "hijacking private property for the purpose of planting a Government-controlled loudspeaker in the home and on the person of every American.""

i think they're going to lose the shit out of that lawsuit. They're suing for things that have yet to be done. Add to that, they had a lot of coverage letting people know this test was coming. It's not like weather alert radios that test weekly. until someone starts sending alerts by accident several times or spam like, i don't see it going far at all.

No, but the phones they are forcing you to accept their alerts on sure the heck are. I guess it comes down to whether the government can force you to view their alerts on privately owned hardware via services that are not free. And if the answer is no then I guess they can't force emergency broadcast alerts either?

Edit: I don't see them wining this lawsuit either, especially since they listed Trump spewing disinformation as part of the reason they are suing. Either it's okay for the government to issue alerts or not, you can't say you don't like it because of political disagreements with the current president. Maybe if there is legal criteria for what can be issued via an alert and it is violated then there could be a problem, but not just for general dislike for the guy in control of the mic at the moment.
 
I think a suit would have to come from a manufacturer over being forced to provide the "service" in hardware or software.
 
I doubt such lawsuit would ever get anywhere. The government can do what they want. They are using these private devices to spy on everyone, and getting away with that. That is much more serious than sending data to them and nothing has been done about it yet.

Are they really private? maybe check the EULA, especially if you are "renting" your phone with one of those stupid carrier scam-er-discount rate plans. I am almost certain that running iOS, Android or...eh, well those, are protected private endeavors.
 
Here in the Netherlands, we have a similar system called NLalert. It is use in cased of public emergencies. And send a message to all phones within range of certain cell towers. It is used in cases of large fires that can produce hazardous smoke (chemicals, asbestus etc.), flooding, terror attacks etc. and few people have a problem with it.

It is set to replace the warning sirens (that are still tested on the 1st mondag of every month at 12:00) in a few years.

However calling a system like it a presidential alert....
