I just got fired from Alienware.com!!!

Get a lawyer for being released from a job after only six months of employment???

How in the world is he damaged enough where the cost of a lawyer could possibly be justified? (And that's assuming that Alienware did something improper, which it doesn't sound like they did.)

I would ask yourself if it's really worth all the trouble and expense to get a lawyer who will likely not be able to do very much for you. If they try to stiff you on some important benefits or severance pay then it may be worth it, but if you are doing it just as revenge in the end you will be the only one who gets screwed.

I said he should ask a lawyer about his position rights, NOT that he should take an agressive stance and prepare to sue. His rights, as well as any potential damages, depend on the conditions of his employement, including the terms of any employment contract or any other promises, written or oral (and documented).

My point was only that he should have good infomation from a reliable source. This may, or may not be a case of unfair employment practices, but unless you happent to be a labor lawyer, most of us are in no position to give him good, accurate advice.

I would at least consult with an attorney on your situation. Make sure it's an attorney who specializes in employment issues. You don't have to spend thousands of dollars taking legal action but it can't hurt to get a quick 2nd opinion from a professional who knows what they're doing.

But unless there is some huge detail that we aren't getting (a signed contract, discrimination, etc), I think he should just move forward with his life.

Imho, too many people put too much effort into things like this and should turn their attention to something more productive.

Under Florida law, employment contracts which do not specify a definite term of employment are terminable "at will." In other words, an employee can quit or be fired at anytime for any reason, other than those proscribed by law (e.g., race, sex, handicap, age, etc.). Recently, some plaintiffs have challenged Florida's at will policy, arguing that the employer's personnel handbook laid out a termination procedure requiring good reason or cause. The courts, however, have largely resisted these arguments and continue to view most employment contracts without a definite term of employment as terminable by either party at their discretion

It means that an employer can fire you for wearing the wrong color socks to work on any given day, even if the correct sock color that day is secret.

Severance pay is a courtesy, usually reserved for administration, or spelled out specifically in an employment contract.

And that is one of the best things about Florida. It is a right to work state. Which means we also have the right to fire you just because we can.
