I just got a speeding ticket! (in California)

For the curious I got charged with a 22350 aka the "Basic speed rule"

"No person shall drive a vehicle at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and surface and width of, the highway.1 In no event, shall a speed such as to endanger the safety of persons or property. Veh. Code '22350"

Saying I went 53mph in a 40mph max? If anything that is supposed to be a "22356(b) Exceeding the maximum speed limit, as specified" 😕 Who did I endanger? The weeds? The fence?

a) There is no speed limit posted. Meaning speed limit is 55mph and/or the "basic speed rule" (see above).
c) It was a nice, clear, typical Southern California morning at 10:16am. (see pics)
d) There were no cars in visible sight and there are no houses close by. (see pics)
e) He didn't even check my registration or insurance. 😕 Checked it as "same as driver" which it is most definitely not.

I'm innocent! 😎 *puts on flame retardant suit*
 
Just looking at the pics of that road I wouldn't have chosen to go 53 and especially not 65. Common sense tells me that road is a 45mph road if nothing is posted.

There is plenty of property there though. Trees, street lights, signs, fences...
 
I'm not sure about 10 in the morning, but I'd do 65 on that at 10 at night .. at which point I'd be breaking the law and also probably recieve a ticket if I got pulled over. I'd do it, but it's wrong. Now just pay up.
 
You got a ticket? I thought the State Troopers and Highway Patrol in California were just decorative.

I do about 80 for about an hour on the 101 (posted 65) every day going to work and coming home (when I get free of the afternoon traffic). The cops seem to ignore it. Maybe I'm not going fast enough? 😕

Everyone posting about traffic ticket and how to avoid paying the fine has always been slowly roasted over constant heat by fellow ATers. Yet new post always pop up in a regular basis. Glutton for punishment?

are you going to take it to court? you can, claim negligence by the police officer for not checking your insurance papers and not following protocol, hence he could've been pulling you over without good reason either.
 
Nice pics. I probably wouldn't go 53 there. There are sidewalks with posts and trees right there, and there are no shoulders. If I found myself on that road, unsure of the speed limit, I would probably drive 35-40 on that stretch to avoid a ticket.

So, there's no speed limit? Huh? Are you sure? (In my city, and most others, that means 30 MPH, not 55, BTW.)

If it was a clear day, and you're sure the speed limit is not posted, and you're sure you could legaly go 55 in that unposted zone, you probably have a case.

looks like every other road in California...just choose some spot randomly on the map and you can probably find a road eerily similar, it kinda looks like the road by my grandpa's house in Tracy. I would probably go between 45-50 on that road. I know how you feel, I once got a ticket for 45 in a 35 zone in Moab, Utah at 5:30 in the morning, cop said I was endangering other people, what people? It was 5:30am, there were no people. I'm still bitter by the way.
 
In California, unposted limits are 55 or "safe for conditions" whichever is lower.

I've been nailed by the "safe for conditions". Basically, it's whatever the cop wants it to be. It was dusk, and I got nailed not too far from where the OP was for doing 45 on an unposted road. Cop said 40 was the maximum "safe" speed due to it being dusk. :roll:
 
I know exactly where that is. I've driven down that road every now and then and never seen a cop. I learned from my mistakes, no longer will I drive like its stolen.
