So you're referring to DHS or ICE officers?
Generally those guys won't show up at your door without reason. But I doubt a warrantless search of your home would be admissible evidence in that case.

If they hear a gunshot and screaming, they can break a door down and enter at gunpoint.

If they have been watching your house, see you bringing in all kinds of flasks, meth making products, etc., they need a warrant.

I don't know about the homeland security laws, or what exactly you are talking about though.
 
While I am a FERVENT opponent of the PATRIOT act and how civil liberties were curbed through the past 8 years all in the name of "homeland security," no cop at any level is going to, on a whim, bust down your door and hold you at gun point just for the hell of it.

Bring political reasons into it and it may be a different story. Does it happen? Not that I know of. Does it have the potential to happen? You bet your sorry ass it does.

even before 9/11, this kind of stuff happened. Secret Service busting down an undergrad's apartment at Duke b/c some douchebag "tipped" them after seeing her anti-Bush posters on the wall.

douchebag decided she was threat to president's life. There was no warrant involved in this.

Of course, the secret service arrived and was wtf pissed about their time being wasted. But it seems douchebags abound and are free to make baseless, politically motivated accusations about anyone.
 
Warent or not it does not really matter. Either way they're still coming into your house. Which sucks as you can't feel safe in your own house, if you're in a place where police are aggressive.

This is why if you have any kind of operation going on that would peak their interest, such as mass piracy, you better have a kill switch!
 
If they see a crime being committed then sure, otherwise warrant is needed and not hard to get.

And for all you crackpots, it's not all President Bush's fault.

What are you basing that on? I wouldn't have the slightest clue how easy or tough it is to get a warrant, and I was a cop...
 
Yes if they have probable cause they can pretty much bypass a whole lot of civil laws that protect the ordinary public. From my experience with my Judge professors it is easy to get a warrant and many of them have been waken up at night to sign for them.
 
Supposedly, under the Patriot Act, you still need a search warrant signed by a judge, it's just that the searching officers are not required to present the warrant to anybody nor disclose the contents of said warrant, including which judge signed it. The only time these secret warrants would ever come under public scrutiny is 30 years down the road when they are declassified but by then nobody will care anymore.

They have to have probable cause that a crime is being committed or that someone's life is in danger. If not, it's a B&E.
 
Yeah, they "can". This doesn't mean you shouldn't attack them for invading your home, though. Just because there's a bullshit act, doesn't mean it's okay for them to abuse our human rights. We deserve better than that.

Personally, I have a better chance of being assaulted and killed by fascists in cops clothing than by terrorists from the middle east. It's not okay, no matter how many acts are signed by worthless dog presidents.

You need to see previous history and cases. When police enter a home and shot dead most times the owner is not charged with anything.

If an officer enters your house unannounced/forcefully you kill them. You will most likely not be charged with any crime depending on your state.
