I havent really touched alcohol for a long time.

I had them both around an hour and half ago.

Legally, you were perfectly fine. Hell, I doubt that would have even registered in a BAC test.

BTW, from some of the posts in this thread it's easy to see how well the MADD propaganda and hysteria has worked.

find a BAC , you are below the limit probably

So he is below the limit...a van filled with kids pulls out in front of him.
His refexes are just slightly impaired due to the 2 beers.
he kills all the occupants of the van.
So whats he going to tell the parents of the dead kids?
I only had 2 beers??
Things that make you go hmmmm

That's the point of having a legal limit. Below the limit, you haven't had enough to impair your driving. If he had been in that accident, the beer wouldn't have been a factor at all. He would have gone to jail or not depending on the circumstances.

Also, whoever was driving that van would have been at fault.

I have always been told it takes approximately one hour for the body to metabolize 1 alcoholic drink (mixed drinks or beer). Therefore, if you drank 2 drinks, and you finished the last one an hour and a half ago, you have virtually no alcohol whatsoever affecting your system.

type of drivers license?>

CDL, .02 is DWAI,
.04 is DWI.

This now applies in NY State, no matter what vehicle you are driving.

WHAT ABOUT COMMERCIAL DRIVERS?
Compared to other drivers, every driver holding, a Commercial Driver License (Class A, B, or C) is held to stricter Blood Alcohol Content (BAC) standards, and faces tougher penalties, while operating a vehicle that requires a CDL license. A single conviction for DWI, DWAI, or having a .04 percent or higher BAC requires a minimum 1-year revocation of the driver's license (3-years, if driving a vehicle that requires hazardous materials placards). A second conviction within the driver's lifetime results in permanent revocation, with a possible waiver after 10 years. A third conviction results in a permanent revocation without any possibility of ever getting it back. Drivers who hold a commercial license should review the Commercial Driver's Manual (CDL-10), available at motor vehicle offices, for additional information about penalties that apply to them.

Sorry but the NY State DMV website must have lazier than me
State workers, not updating the site.

The law did change last year. At least in NY State,
the CDL, DWI rules apply no matter what vehicle your driving,
and that may also mean Boats, Atv's, and Snowmobliles, as well as
cars, trucks, m'cycles.

So for me, its a real bummer, I have to be super careful about if I want to have a beer.
