I got a ticket...

First off, I'd like to say that one of my friends tells me that it is impossible to get points on your license from a non-moving violation. I'd love to believe this, but that is the exact opposite of what the cop told me.

I'm in Florida, if that makes a difference. Two days ago I got a fix-it ticket for my tint. I'm not bitching about the ticket as I knowingly purchased illegal tint, and actually I was pulled over for speeding (although I was honestly going with the flow of traffic, the cop even admitted that) but I was let off for a warning for speeding. He did, however, write me a ticket for my illegal tint.

He told me I have two options:

Option 1: Remove the tint, have another cop sign off on it and I pay a $54 fee to have the ticket expunged.

Option 2: Pay the fine of $76 and receive 2 points on my license.

Honestly, I'd prefer just to pay the fine and go on my way. In the end removing the tint will cost me a ton more than the $18 difference in fees. However, if the points on my license increase my insurance then obviously that's not the correct option to take.

So two questions: Is my friend talking out of his ass when he says that you can't get points for a non-moving violation?

If I would get points on my license, would that increase my insurance?

I've never gotten any other car-related (non-parking related) tickets. I've only gotten a jay-walking ticket in high school, damn butch biker bitch!

I'm pretty sure you cant get points on your license for a non-moving violation.

yes points on your license = higher insurance rates.

I've looked over the ticket and one thing caught my eye, the actual offense is "improper or unsafe equipment". To me it sounds like that could be a moving violation? 😕

tint = moving violation
talking on cell phone = moving violation (if it's against the law)

Really seat belts are the only non-moving violation I can think of (besides parking tickets). Those typically don't increase insurance rates. (Depending on the state I'm sure)

Unfortunately tint is considered unsafe equipment (as you stated), so it is a moving violation just as if you drove your car with no brakes.

I personally would remove the tint, as getting one ticket for it does not make you immune to getting another for the same thing. In the end it could end up costing you way more than cost to remove it in ticket costs alone (not taking into account the insurance rate increases)

..if I was a cop I'd be suspicious of heavly tinted windows. Like driving a red car. you make a high profile target of yourself don't be surprised if you get high profile attention.

I have had many speeding tickets (Wisconsin) and never had my insurance go up.
Your insurance company does not check your record on a monthly basis.
The DMV does not seek out your insurance company to narc you out.

When and if your insurance company does check your driving record they probably look at the violation, not the points.

You should be talking to your Ins Agent. Call a different agent or dont give your name if you are paranoid.

Wisconsin fines are punishment enough. I'll never speed up there again...

How many tickets do you have to get with your illegal tint before it becomes cheaper to remove it than to continue getting tickets?
