I don't want to cut down this tree

background - the neighbor behind our house sold their house. it was written into the contract that they would cut down this tree near our fence because it is dead.

well, after they did a survey, oops, it turns out that the tree is 70% on our property line.

so now, they approach me wanting my permission to cut it down and pay 70% of the fee (estimated total cost is $400, so that'd be $280)

I'm blindsided by this. there are some options I guess I could go with.

But I'd like to hear you guys' opinion on this. (1, I'd rather not cut down the tree, if it is going to fall, it's mostly likely going to damage my fence. and 2, I'd rather not spend that money... )

update:

they really did cut down the tree... and we didn't get a bill.

they moved out, haven't met the new neighbor yet...

don't pay the contractor, and then the neighbors will be forced to pay it all.
 
Were you OK with them cutting it when you thought it was THEIR dead tree?

Since it's dead, is your only objection that they want YOU to pay for it?

Since it's in their selling contract to cut it...let them...at their cost. (or be a prick and charge them for cutting YOUR tree! Demand that they replace it.) 😉
 
tell your neighbor to pay you $280 to cut down the tree, and say that you're going to do it when they move away 🙂

Well, you could, but at the very least it means the bill isn't binding if they try to send it to you.
 
I would refuse to pay considering they never even waited for your approval and they're the ones that want it cut, not you. If it was a live tree I'd even bring them to court over it.
 
1st: Why are you against cutting down a dead tree? If it falls you do know insurance could deny a claim because you knew it was dead and didn't take care of it right?

2nd: Since point 1 doesn't matter now that it's being cut down, don't pay for it. Unless you agreed to pay it or signed something, you are not legally required to pay.

I agree with 1. but with your second point: if the OP knew that a contactor was cutting down the tree and did nothing to stop them, since he is reaping the benefits of having a dead tree removed, he could be bound to pay his portion of the bill.
