A judge has issued a temporary restraining order that prevents the release of a 1994 videotape documenting a breast augmentation surgery for Anna Nicole Smith.


Before her death in February, Anna Nicole Smith spent years in court pursuing her share of an oil fortune.

Superior Court Judge Mitchell L. Beckloff granted the order Friday at the request of Smith's former attorney and executor of her will, Howard K. Stern.

The injunction prevents the sale, distribution or dissemination of the videotape.

In court documents, first obtained by CelebTV.com, Stern accused Gerald Wayne Johnson, the Texas doctor who performed the surgery, of sending a tape showing the procedure to Thomas Riccio, a Los Angeles-based memorabilia dealer.

Stern claims the surgery was taped without the former model's consent.

Smith died of an accidental drug overdose in Florida in February at the age of 39.

In a letter written June 22, Johnson said he routinely records surgeries with the patient's permission and promises to keep the video confidential "during the patient's lifetime." Johnson said he gave Riccio permission to use the video after Smith died.

Stern claims Johnson's wife and Riccio would share in any proceeds from the sale of the videotape to various media outlets.




Ok this is just disgusting not to mention unethical of the doctor. I can understand video tapeing in case something goes wrong. or for scientific reasosn. BUT to make a buck? man that is just wrong.

 
Yes it is wrong to me too, and what's just as bad is the fact that there is a market out there to make it worth it to the doctor to even think about it. The other thing that is stupid, is the fact that tomorrow he will still have all the patients he had before this became public.

How does this differ from all the other videos of famous surgeries that are on the discovery channel all the time? i.e. Siamese twins who died after complications, grotesquely deformed people receiving surgeries in an attempt to correct the deformity,etc.

Those at least have some medical curiosity or educational value attached to them, and I assume those patients signed consent that explicitly gave permission for the videos to be distributed.

Seeing Anna Nicole's DD funbags being installed is a routine surgery, releasing the video is purely an attempt to capitalize on her celebrity. Just seems underhanded and unethical and gross to me. The doctor may not legally be in the wrong due to how he worded whatever she signed, but I bet he wasn't planning on his name making the news for this. Maybe karma will put the hurt on his practice when he becomes widely known in town as the doc who passes around vids of his patients.

I am going to say that those videos are aired with the consent of the families that they are for educational purposes... You don't see those videos on Fox's new "Grossest and Craziest Medical Deformities and Surgeries Part 5". The doctors and producers don't put it out there to shock and make a buck.

This doctor is just trying to make money by violating her rights. I am sure that just because you die doesn't mean you lose all your rights. Would you appreciate if you had a video tape of a hernia operation or a prostate exam for sale on DVD just so people could oggle and belittle you? There is no difference here. Various parts of the Hippocratic Oath are being pissed on by that doctor.
 
Oh, I'm not saying that I don't agree that it's not right.

However, you must not peruse the "educational" channels often. There are a lot of shows with surgeries in them that are for nothing other than sensationalism or curiousity. Little children with 1 in a billion diseases that cause their head to form weird bone-like growths, resulting in a head that looks like - I have no comparison. They get shipped to another country and receive round after round of life-threatening plastic surgery. The whole thing is on television, accompanied by some touching story.

The guy does unnecessary cosmetic surgery. Pretty far down the totem pole, as far as the medical profession goes.
