Hypothetical child custody question

So if i had a kid with my wife in Utah, and she was a drunk and a crappy mom so i moved to another state, would that be kidnapping?

Well if you are divirced and If the kid is living with you and you have never gone to court over any custody issues then I think it would be ok. But then she'd probably fight it and you'd have to come back and share the time she gets with the kid.

If you are still married I'm sure you can get in a lot of trouble. If you are worried about her hurting your kid get a restaining order or something. Start some legal procedures. Dont just take off with the kid.

I don't know about Utah, but in IL crossing the state line without the courts blessing can be a big deal. My ex did that once with my daughter (I only had custody of my son at the time) and the court was going to take action if she didn't promptly come back. Even now that I have FULL custody of both of them I would have to get the courts permission to permenantly move out of state. I can leave for vacations without permission, but only for a finite time.

If you don't have full custody I wouldn't even consider it, especially since you're male. Again this probably varies from state to state, but here rights automatically revert to the mother if no custody agreement is available. Me not having my custody agreement on my person almost resulted in my going to jail once. Get a laywer. If she's an immediate danger, go to the police.

No. You can move wherever you want. But you can't take the kid with you unless you have custody. ;)

It's definitely different from state to state. My parents divorced when I was 1. My mother had full custody, and she never had to get permission for us to go anywhere. My Dad and I went on out of state vacations and he never had to ask for any kind of legal permission at all

Make sure you can prove this in a court of law. Make sure this can't be proved against YOU in a court of law.
They allow same gender marriage in UTAH?

I said I didn't have to get permission for vacation, only permanant relocation. I'm pretty sure that the non-custodial parent can constest a relocation out of state in almost every state. If the non-custodial parent doesn't complain then it's a moot point anyway. The state isn't going to be aware of your move, much less pursue legal action without a complaint from the other parent.
