Actually around here that would be for a jury to decide. How do i know this you ask? Well let me tell you. I actually sat on a jury for a young man being tried for DUI. He actually tried something similar to this as his defense. Car went off the road into a ditch. His buddy heads down the road to use payphone at store. Sheriff comes by and stops. Determines driver is intoxicated. Arrests him for DUI. Driver claims he was sober at the time he went off the road but got drunk waiting for his buddy to get them some help. Claim was that he basically drank enough booze in 20 minutes to blow a .17. We weren't buying it and hammered him.

DUI = driving UNDER influence

This is proven by being pulled over, and given a sobriety test, if you fail that means you were driving while drunk.

If you're pulled over, THEN drink, and are given a test, it can't be proven that you were drunk BEFORE/WHILE driving, instead of AFTER being pulled over and stopped.

Open container in vehicle+public intox=no better

How about just dont drink and drive, that or kill yourself if you cant handle that little bit of responsibility.

the breath test is a terrible way to measure the amount of COH in one's blood. In science, it would never hold up as any kind of real proof.

I once blew a .168, I can't remember the beers I had...something like 4-6 between 6-8pmish and 2am (I had my tab with me).

Fuck fighting the damn thing though, in Florida you can't drive at all if you protest it...it takes about 6-8months for a court date then usually you need a second one for the sentencing....look at about 1 year without being able to drive even for work.

Or just pay it out, about $4-6k and you are back on the road in a month. It's all about revenue.

The reason I blew so high was my teeth had almost punctured my whole lower lip due to an accident earlier that day. Any blood in the mouth or even a stomach ulcer can throw off the readings substantially.

DUI law is truly not about saving lives, it's per revenue generation.
