I just changed hard drive(quantum OEM drive) pulled from a Gateway Select 400. Maxtor told me that I still have the warranty thru Gateway. It's less than three years old. I called Gateway and they told me it's my problem.
I told Gateway to just ship it back to Maxtor(quantum) to replace it. Gateway says basically that I am sh*t out of luck.

Should I just drop it or what ??

Gateway su*ks!

I'd try Maxtor again. Tell them you've been messed about by Gateway so much your losing faith in Maxtor drives altogether.

Then again, if its Gateways problem they should really sort out the problem- but I guess as long as you get a good result the means shouldn't matter.

But no, you shouldn't just drop it. If you are entitled to a replacement drive make sure you get a replacement drive!

Drives sold to a manufacturer carry no factory warranty. Gateway, Dell, etc., get excellent pricing on the drives because they completely take on the burden of supporting the drive. The system manufacturer will warranty the drive until the end of the system warranty. This has been standard industry practice from day one. As long as the system that the drive came from is still under warranty, Gateway should cover it. (Don't tell them you took it out, of course.)

Then why did Maxtor/Quantum tell me that there was still a warranty left on this OEM drive when I spoke with them this morning??

Huh??

Have no clue unless they looked at the manufacture date and 'assumed' Gateway would still cover it.
