Get the District Managers name and call him. That should get stuff done.
I know this since I used to work in retail. Anyone who would call the DM would always get their way. You could always create an argument that you will go to the press if they do not fix or replace your tire.
 
I'd suggest trying it at the local store, making certain to jot down the names of anyone you speak to, and the gist of what they tell you.

Then, if you get shafted, contact corporate, and raise a stink. Basically, you were sold a service by their tire center, and didn't receive it. That's theft. If corporate balks at helping, get some news outlets involved, and see if they'll send out a reporter to talk to the manager at that Sears. Make the wheel squeak loud enough, and they'll grease it, ya know??

Actually, you're probably lucky that they didn't do a patch on that tire, since I'd bet their liability on work performed would only be for the value of the work. Since they charged you for work, then (obviously, and witnessed by the other Sears store manager) didn't do it, they should be liable for the damage caused by their negligence. If they're still balking, I'd call the cops and swear a complaint against the manager of the store, unless he can provide you the name of the mechanic that didn't do the work, but must have said he did (since you got charged).

I'm no lawyer, but I'd say you have a case. Good luck!
 
Our refrigerator from Sears died after a month. Kenmore Elite which cost my parents over $2000 as one of our wedding gifts. We got a replacement after bitching to our sales rep who sold us the fridge. One week past the one year anniversary of purchasing the original fridge the ice maker stopped working. We had incidentally just received an offer to extend our warranty on the fridge a few days earlier. The end result of my calls to Sears Customer Service including involving every manager available on this issue was 1) they voided the warranty extension offer 2) they wouldn't honor 12 months from the date of receipt of the replacement fridge and 3) they offered to have somebody look at the fridge for $350. Then the water stopped working. And the front frame accessible after you open the door began to be blazing hot like almost burn you hot.

Considering my options......which included pissing myself, getting an ulcer, screaming furiously at CSR's making $11/hr who couldn't give a shit for hours and hours......I concluded I would buy a three pack of ice cube trays from the dollar store, start buying bottled water instead of those expensive ass filters for the fridge, and would never buy a single thing from Sears again in my life unless I was sure they were taking an enormous loss on it. Tens of thousands of dollars on appliances, power tools, and home improvement services in the five years since then I still have only stepped foot into Sears once and it was to pick up a work bench that was selling online for 85% off. And it wobbles. Bitches.
 
At very least get your repair fee back.

However, I don't think that its normal for a tire to be ruined by being flat for one day. How old was the tire and how many miles did it have on it? I wouldn't expect anyone to replace an old worn tire with a new tire.

🙂 If it will make you feel better, my local Home Depot had a fridge in the same price range. They got down to their last one of that model - apparently GE changes the model number from year to year or every couple years although the fridges are nearly identical. Home Depot had the floor model clearanced for quite a bit off. Had it on their website, but no mention of clearance either in the store or on the website. Rather than purchase it at HD, I used Sears' 110% price matching (match the price, plus 10% of the difference, which turned out to be a significant amount.) PLUS, I was barely able to get in on a $100 rebate with GE. On top of it all, I was able to get free delivery from Sears.
 
If you have a receipt, any Sears you go to should make you a happy customer. If you fial, ask to see a superior and that superiors superior.
 
Discount Tire patches tires for free, regardless of where you bought them. That's why I'm a loyal customer.

If the sidewall cracked after being flat for one day you had more problems with that tire than just a hole. It shouldn't do that. Heck my grandparents old car with some really old tires on it didn't crack a sidewall when the one sat flat for a week.

I think the sears just owes you your $25, and that's it.

Why do you expect them to go out of their way after the warranty? Honestly we're pretty good about being lenient but there's only so much we can do. Buying the protection agreement for any appliance is a smart idea.

total noob question here: could they have patched the inside of the air chamber instead of the "outside" part that is seated on the rim?

i have no idea how tires are patched. just an idea...

not much more. the tire had 32k onitit was near the end of the life span and most likely over it.

they sure don't owe you a new tire.

we bought a 4 yr warranty on a Bosch front loading Washer/Dryer set at Lowes. The washer was a total POS - the plastic housing around the controls cracked several times.

I have to admit that Lowes was great about sending people to repair it. However, after awhile, the washer developed a disgusting moldy smell - I searched online and many others had exact same issue but Bosch would not recall the machines.

We could not get rid of the smell - tried running empty loads with bleach or vinegar etc.. would leave the door open to let it dry - nothing would get rid of the smell.

I called for service at least the minimum 3 times before they would classify it as defective - they fought me tooth and nail - they would not replace it.

The CSR was a total bitch. She said that the "replacement committee" deemed there was nothing preventing the clothes from being washed so the machine was not defective.

she told me to take it up with Bosch - I asked for the # and immediately conferenced Bosch in on the call (much to the dismay of the Lowes CSR).

After about 10 mins of arguing and making my case, the lady from Bosch said she'd have the washer replaced for free. They sent out a service guy who carted off the old and installed the new.

If one day flat made the sidewall crack, that tire was pretty well shot and unsafe already.
$25 you are owed, not a new tire.
 
A rim sitting on a tire overnight is not going to do the damage. ANY driving on the flat tire will damage it.

Also, if they did not patch the tire, you would not have been able to drive on it.

The tire was plugged from the outside and you either had another small leak or created a new leak on the way back.

At 32K miles, the tire was probally on it's last legs if the sidewall then cracked - what was the original mileage estimate when your purchased the tire?
