How exactly can one be under arrest for strictly resisting arrest?

Must one be under arrest to begin with? :confused:

I was watching an episode of "Party Police" on CourtTV a minute ago and the over zealous cops told the perp "you are under arrest for resisting arrest!" as they were sitting on the guys face and twisiting his arms for "not being cooperative".

I dont know if you watch this show, but the cops revel in being heavy handed and laying down every letter of the law. Kind of like calling in SWAT for littering. :shocked:

Its way over the top.

IMHO if the guy hit his g/f in the face, he deserved a whole damn lot worse than what he got.

Hey Im not condoning it. He deserves what he gets! But you know the cops do that all time, and not just to wife beaters but anyone who gets "uppity". :(

(And btw in real life, I dont get uppity. Its just yes sir / no sir because I do have respect for the tough job they have to do. Even if I get mad over a questionable ticket, I just wait to fight it later rather than try to resolve it on the spot)

You can't really compare getting 'uppity' with a police officer with getting 'uppity' with an IT geek. The geek might be able to control your access but he sure as hell can't put you in jail.

When a cop asks you something you respond truthfully. If he tells you to do something you do it. He doesn't care how fast your upload speed is. :)

Don't forget obstruction of justice. Martha Stewart went to jail for covering up activities that weren't illegal in the first place.
