DCOLORADO SPRINGS, Colo. -- A $20 pizza could end up costing a Colorado Springs man $743.85.
Russell Tellup had a Domino's pizza delivered. He gave the delivery driver a $20 check that ended up bouncing, according to KRDO-TV.
"As soon as I found out that it bounced I contacted Dominos to find out how to take care of it," Tellup told the TV station. "They told me I would receive a letter in the mail."
That letter said he owed $40: $20 for the pizza, plus $20 more.
"I never received the letter," said Tellup. "Apparently they mailed it to my old address, which is my girlfriends address."
A few days ago, Tellup received a summons in the mail at his new address. Inflated Dough, Inc., the company that owns the Dominos store that delivered the pizza, was filing a lawsuit against Tellup.
Under Colorado law, if Tellup had paid the check plus $20 within 15 days of receiving the letter, he would only owe the $40.
However, by doing nothing, he faces $743.85 for check fees, court costs and attorney fees.
"I think the Legislature said 'OK, theres going to be a penalty here, but were going to give you a chance to redeem yourself and pay the check,'" said Attorney Herman Lohse told KRDO-TV.
Tellup has the option of settling out of court for $600. He said that is what he plans to do.
