How come prostitution is illegal but porn is not?

I don't know if prostition is technically legal there (I doubt it), but controlled prostitution via calls girls and brothel houses are all over the place. As soon as you walk off the airplane you can get catalogs of women to call for sex. In fact you can barely walk down the main streets without getting flyers or catalogs for prostitutes. Its pretty obnoxious.

I've been to Vegas on business trips for about 8 weeks this year. Prostitution is illegal in that county, but legal in most other counties in Nevada. There was an "America Undercover" special on HBO last weekend about a real brothel in western Nevada called the "Midnight Bunny Ranch". Very interesting, if you're posting in this thread you're probably interested and should try to catch it, it's informative and interesting without being vulgar (T&A everywhere, but what else do you expect in a brothel on cable). Prostitution isn't legal in Henderson county (where Vegas is), but from what I saw, it wasn't strictly enforced either. It's not called Sin City for nothing. Every couple hundred feet there are those free newspaper machines with books of women. I'm sure the "escort" section of the phone book is an inch thick (I didn't look). There are strip clubs and billboard adversisements everywhere. I was never actively solicited in Vegas (In Thailand I couldn't go two blocks without being solicited), but it is pretty pervasive. I'm guessing that the casinos want to project a family atmosphere and keep the streetwalkers and obvious ones away. The escorts can get away with it because 1. they are more discrete and 2. they are charging for their "time" and what happens between two consenting adults is their business.
Most European and some Asian countries have set up "red light" districts where prostitution is legal. I walked through the famous Amsterdam one, just for the experience, and I got lost in Seoul once and ended up walking through the red light district there. Interesting, to say the least. Very much a business.

Its a common misconception that prostitution is legal in Vegas and Nevada. I believe there is only one county in Nevada where prostitution is legal and Henderson isn't it. Even so, its pretty much enforced with kid gloves and treated about as serious as loitering. I believe the fine for prostitution is like $20. They do have the law on the books so that they can police it when it gets out of hand.

The "unwritten" rule that is given to law enforcement is that its not a priority as long as its done discretely and prostitutes aren't hanging around all over the streets propositioning people.

Wait till there is a cop around and approach the prostitute telling her you want to pay her to make a porno with your friend who is the other "actor".
If the cop sees this and doesn't arrest you then you know you're right. If not, well, hope you have a good lawyer.
 
First of all, it should be legal. How much it costs you, when, where, and with who you have sex is not the government's business.

Now, as to what proponents of prostitution being illegal would say, here is one explanation.

Prostitution is illegal because it is unregulated. There are no forms to fill out; no bbb to check whether the sale followed protocol and no one got screwed (pun intended); no agency to make sure that kids, illegal aliens, and other helpless people aren't exploited; and as mentioned before- no taxes being paid on the sale. There is no legal business transaction in this country that doesn't have those safeguards.

The porn industry is required to check documents and make sure that every actor is over 18. There is an agency that has the power to check. Everything is licensed and documented and yes, taxed, and there are inbuilt protections for the women in doing so. The pimps, the prostitutes that proposition people that find the idea offensive, the kids, and the general violence that is associated with street prostitution is taken off the table.

Erm you do realize that if the government did make it legal, everything you mentioned would then be enforced by the government. There would be no minors, std tests would be regular, and sales tax would be collected...etc

That's a good point. The same argument that is used to legalize drugs ( all of the crime, death, violence associated with it wouldn't be an issue if we could buy it in stores). It's actually more relevant with drugs though.

By it's nature, making prostitution legal would not immediately lend itself to regulation and control of it. Legal prostitution wouldn't automatically be more desirable than illegal prostitution. And you are conceding that there are some forms of prostitution that should be illegal.

You would have to make it legal in certain houses or such where it can be monitored. What about the people that don't want to be seen going into these houses? So you'd have to make it legal for them to travel places? There are plenty of guys who have girlfriends or wives that only feel comfortable getting off in a car on some street. Gonna make that legal too?

Then there are the illegal aliens and kids and drug addicts that couldnt find employment in the legal prostitution places. They would still have pimps and still be working the streets charging less than the legals. You can make all sort of concessions and you'd still be back on the streets cleaning up the street prostitution.

Well, consider this scenario: you hire a person off the street to do your garden work and pay that person $100 after he/she is finish. You paid that person for their service. How is that different from hiring a prostitute for their "service"?

You don't see law enforcement cracking down on the people standing in the corner waiting for labor work, but you do see undercover cops busting prostitutes.

I think part of it has to do with taxes and how the government cannot regulate the flow of cash in prostitution. The other part of it is that if prostitution is legal, the whole country will be banging each other, having fun, and be making money. There'd be no goods produced except new babies!
