Do we automatically assume that the first person who steps onto North American land to be the owner of all land and anyone who comes afterwards is an [illegal] immigrant?

Migrants from the land bridge didn't exactly destroy nature either, especially not to the degree that Europeans did. A few megafauna died but that's it.
