How can you be arrested for something if you're already in custody?

I'm confused...

He was already in custody (like hell they were going to let him out while they were digging bodies out from under his shed), yet now they're "arresting" him on charges that he killed the two girls (of course he did).

???

I think they've confused "charged" with "arrested"...

That would make more sense.

Regardless, you can be detained without actually being arrested. Being arrested implies that you have been formally accused of committing a crime, while you could be be detained voluntarily, or for your own protection, but your detention could lead to your arrest.

Of course, based on the constution, you can't be detained without being charged, so you can request to either be charged or released, and quickly.
