A charge on your card means that they are subject to litigation for the difference as depicted below:

(market price * number of modules ordered) - (order price * number of modules ordered)

Being that the market price for this stick is at minimum $240 (Micron mem is expensive), and given an order of 10 sticks, you have:

$2400 - $350 = $2050 CASH IN YOUR POCKET - after a year of troublesome small claims litigation.

I DO NOT condone this action as it is both immoral and not worth your time. But that doesn't mean you can't do it, because you can.

A charge on your credit card is considered an agreement of the contract (the order) to provide the goods at the agreed to price.

Federal law states even if they try to credit you, that DOES NOT resolve the contract. Furthermore, if they refuse to fulfill the order (or can't) you can sue them for the difference between what the goods would cost from another store and what they agreed to sell the goods for.

This is how I got lots of cheap crap from amazon.com during (and after) the toy "sale"....they had charged my credit card so I got the product at the price I agreed to.

NOTE: This applies to real charges and NOT mere authorizations.

Where'd you get your law degree?

Try and make that one stick. If they made an error, even if they charge your card they're more than able to cancel your order. All they have to do is refund the money before they ship the item. Now if they ship the item, that's something completely different.

Reminds me of how Buy.com had the balls to ask folks for that $50 back they messed up on. Of course, nobody responded and they never mentioned it again...
 
Well i ordered 4 sticks, clicked submit got an error. It said to resubmit. So i clicked back, and resubmited. Went through. Got two emails, with diff order numbers. Guess the first one went through. Check my order status, it appears my card has been charged. SWEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEET!!!!!!!
 
Wag: You're wrong. I don't have a law degree, and I don't know why you think you know everything about the law, but I can tell you that you are wrong. They cannot cancel anytime before shipping the item. Once they have charged your account, they have accepted your offer to make the purchase and any breach of that "contract" on their part is subject to litigation, as depicted above by myself and another.

Get your facts straight. And trust me, I KNOW what I am saying is fact.

yeah, after being a "victim" here on hot deals for all the deals gone bad...we all seem to understand consumer law to a degree. as i understood it, it's stated in their policy, i think, that they are not liable to errors in pricing and such etc. etc. yada yada yada. legally their butt is covered, but if they ship the product to you and charged you the price in the contract then they can't charge you again or get the item back. you may never shop there again but they sure ain't getting their stuff back after its shipped.
 
NO: Their policy means ABSOLUTELY NOTHING. A company cannot have a disclaimer that allows them to apply the bait and switch technique. Disclaimers can do a lot, but they cannot provide a shield for companies to allow them to continue doing unlawful things.

And that's why this law I have mentioned above is in place, to prevent purposeful low-price attention schemes which the company has no intention of honoring. Although 99% of these cases are not schemes, just pricing errors.

i don't think it means anything though. they can just say that they are out of stock and just forget about you...we've had that happened before...$50 SbLive platinums....
 
I remember a while back when UBID listed one of their Intel 733 computer system for $3. I bid like 4 of them and won the bid. No doubt that UBID did not have the systems to ship be so the order was canceled. I did however receive a $200 voucher; $50 for each system. It's worth a shot 🙂

I can't believe that the "legal" discussion has already started and these haven't even been cancelled yet!! Usually it takes a couple of days before the bickering begins.... 🙂 IMO there is a huge difference between an authorization and a charge to a credit card. It usually takes 2-3 days at least for the "hard" charge to appear on your card, giving them plenty of time to cancel the order and rectify the matter of your credit card. Our only hope is what the above poster stated, that the items are shipped out before they catch on. Once I get it, it isn't going back. Unfortunately, even if they are shipped, remember the bunny episode. They can probably stop the shipment in transit..... Oh well, it doesn't hurt to dream.... 🙂
 
hahahaha...not when the ups guy is at my doorstep and i rip the package out of his hands and sign for it...anyways...let's remain optimistic...i actually want this ram. i have a pressing demand for them.
 
I did the math and I believe 2 sticks is the best combination w/ overnite. 34.95 x 2 + tax + overnite shipping = $67 and some change. With would be the same amount with more qty of ram as the more memory you order, the more overnite shipping will cost you. I got now total of 10 sticks...woohoo!

8 by UPS ground.

2 by UPS Overnite.

Hope I atleast get 2 of them.

Here's how it works,

so it is 11.99 PER STICK for 2 day air. and 29.99 PER STICK for next day air.
there is no discount or "best combo" of sticks/shipping.

the colums didn't line up nicely, but you see how it works.
in case you're wondering how i got that, i placed orders (but didn't confirm)
for each amount of stick, and then copied down how much each shipping method
was.
