What kind of policy? Named peril or comprehensive.

If its named peril there may not be coverage for ice dam or weight of ice/snow.

Read your policy.

Insurance co. will explain the reason for denial in the denial letter. What is their reason for denial?

The company claims that the leak was due to improper maintenance. This despite the fact that the roof still has warranty left on it.
My aim of this post was to gather suggestions as to how to proceed with insurance companies when one is being given the run around. Also, I thought it would serve other folks who may be in similar situation. I have since found the following article:

Another site that I found useful was :

You should have called the ins. co. first before hiring a public adjuster.

From your first post. The first notice of the claim to the ins. co. is a proof of loss form from a public adj. demanding 60k. The ins. co. lawyered up at this point because a 60k demand for a roof leak claim is insane.

The ins. co. has already documented the reason for denial with photos and depositions.

Your only recourse is to file a complaint with the dept. of ins. or hire a lawyer.

The ins. co. will send the documentation of denial to the dept. of ins. and they will close their file. A lawyer may get a small settlement to close claim for nuisance value.

Good luck.

You state the claim was denied for improper maintenace. Sounds like the roof has reached the end of its useful life and needs to be replaced due to age/wear & tear. Without seeing the roof I have no idea. The most common roofing shingles (3-tab) usually need to be replaced before the so called warranty of 20-25 years.

Disclaimer. My advice is worth what you paid for it.
