Personally, I had a kick out of reading this thread. I have to say, 5150 is a pretty funny guy. The fact is, not only can he spell and type in full sentences, but he also isn't committing fraud, since he technically never won any of the bids. Remember the way ebay works: you don't get to outbid others unless your bid price is higher than what the current price is, and someone else comes along and bids. That means, a bidder had accepted the higher price in the first place, and hence said bidder shouldn't complain about if the price gets driven up. If one walks away with a lower price than intended, then that's that person's luck. But if the same person walks away with an item of a higher price, then that was that person's own choice which led to the bid. Granted, I don't agree with scalping at all, but it's not as if the 360 wasn't preorder-able to begin with (as opposed to concert tickets or something). So anyone who really wanted the system should/would've preordered a long time ago.

So, if there is demand for something, why can't people with supply make some money out of it? If they're willing to shell out $2000 bucks for a system, then why should any of us deprive them of the enjoyment of getting one? I say all those who're opposed to 5150 driving up the price (but not winning) is really just envious of the people who actually has a system to sell, and are selling them at $2k each (but if it's someone that is just messing around and subsequently wins the auction, then yeah, that person is committing fraud).

It never occured to me that anyone would be stupid enough to pay $2k for something that can be had for $500. I would have preordered 20 of them and sold every one. The old saying is true, "a fool and his money are soon parted".


Edit: OMG!!! I just checked ebay, over 30,000 of the things for sale? Didn't anybody keep one?

To all you others, 5150 helped somebody potentially make more money? What's to whine about? People paying $2000 aren't going to care about paying $2,500 for the system. And to all the idiots out there who bought multiple to sell, I hope that you have to pay for about 4 auctions before you sell it, because I know some people who wanted one, even waited in line, but didn't get one thanks to people like you :|

I guess that you didn't know that eBay has connections with every major (and some not so major) IPS's Abuse teams. It's pretty simple actually, all they have to do it is present your ISP with a subpeona (which they will get for fraud) and a log that includes date/timestamp and your IP address for the bid, and they get pretty much all the info about you on your account. You're right that a lot of internet crime goes unpunished, but that is usually because ISP's and the authorities are dealing with semi-professionals that are overseas. You, on the otherhand, are what is known as "low hanging fruit"... Ebay is is busness and prosecuting people that break their policies is good for business. No one would use Ebay if we didn't think we'd get our goods/money. My first indication that you will get caught is the fact that you bragged about it on a public forum, one that also logs your IP... Nothing like a bit of cross-referencing to get rid of that shadow of doubt you will most likely paying a layer out the ass for.

Shouldn't their be laws in place to prevent this type of Ebay hording/gouging? Or is this good for the US economy in which case it is encouraged by the good 'ol US govt.

I don't think I actualy quoted much about law to you. Just wanted to let you know that it is quite possible for Ebay to take action on this. Take it for what it's worth.

The people on Ebay are price gouging and 5150 is having some fun with them. What's funny is that if a business was charging a MSRP of a $650 for a Deluxe system, you guys would be up in arms about it.

Putting a reserve on an item for the pure sake of selling it to make a profit is just as unehtical as someone souring thier sale. If they were willing to stand out there all night or reserve it many months ago, they should be happy to be playing.

It's not capitalism, it's street hustling.

Why do some of you get upset when you hear that people who bought the 360 to sell actually got one instead of those who wanted to play it?

Firstly, video games are a huge waste of time for the most part... on the other hand, aquiring a large sum of money could have very positive effects and should be considered a more desirable outcome.

What if the dudes selling these need to pay hospital bills? (Or used to money to build a REAL PC?) You would deny them so you could play video games?

It's not livers and kidneys being passed around here... it's electronics. Would it be wrong to gouge for a kidney? Of course. An Xbox360 on the first week of launch? Expected/10.

Actually I just sold my XBOX 360 on Ebay for $780. Since I won the XBOX from www.every10minutes.com, I'm very happy with getting $780 for it.

So to all you jerks thinking you're hurting the sellers by fake bidding, I thank you, because you and those like you have contributed in artificially raising the price.

This directly resulted in more money in my pockets than I expected. ;)

$780 seems fair to me, especially since you won it and didn't deprive some guy standing in line who really wanted to just have one to play it... $1600??? Wow... I guess we all have different intrepretations on what is "fair". People buying 1 to resell, ok, I got it. Seeing some guy who has a dozen, well, that is just pretty ridiculous.

I would like to see if any of those 2k plus auctions are actually getting paid:

Probably none.

Also: DEMAND IS WAY TOO HIGH. It would have been impossible for MS to make enough xboxs so they would still be on the shelf after friday. If there were some still left that means that the console would probably be a flop. It is like the PS2 all over again.

No there should not. The 360 is not something you need in order to survive like food and water. It is not even something that you need in order to be a productive citizen like gas is. There are laws for those type of things.

The 360 is a piece of electronics equipment that is meant for entertainment and the US is a capitalistic society. Because of those two facts everybody should be able to sell them for what ever they can get. The only reason why (most) retailers are not selling them for more is because M$ makes them sign a contract stating they will not.
