Well first there was this..

And the other day I got a visit from security around 10pm saying that someone complained about the noise levels in my place (I was home alone watching The Office*) even though the security guy admitted he could barely hear anything when he was outside my door.

Then the following day while at work I get a call from the HOA manager saying that he'd gotten "several complaints" about my noise levels, and each subsequent complaint would result in $150 fine.

Now I'm absolutely respectful of noise levels especially at night and will be more mindful of it from now on...what I just don't get is why people can't take 30 seconds out of their lives to tell me personally to keep it down, instead calling the emergency security guard with real issues (the building has recently had problems with thieves) to come up, then tattling on dad about it, and wanting to impose fines on their neighbors.

heh there was no problem they're just flexing their muscles because you choose to fight the late fee.

tell them they must have been mistaken the noise coming from your house - it had to been your other neighbor

Start calling them and complain about noise and weird odors from your neighbor.

Tell them you'll pay any subsequent fines when there's an official police report attesting to you violating noise ordinances.

This. And any further noise complaints without either a police report or police presence will be considered harassment and forwarded to your attorney.

It's obvious that someone in the neighborhood has a personal beef with you and are tattling to the HOA to harass you, otherwise they would be calling the police. If the HOA wants to be their stooge by cooperating then they need to share the legal burden.

this happened to me before, and the complainer kept detailed records in giant colorful sharpies of all the times we were too noisy. except all those times we were at work so those records didnt work out to their advantage.

Several complaints? Sounds like the HOA complaint office isn't doing their job and sending out letters to you saying you are being loud. If they are telling you about "several complaints" all out once and not right after the complaint has been file, you should tell them to go pound sand.

Also, want does the HOA contracts/ laws/ etc, say about notification of violations? If policy isn't being followed, then you can use that against them when it comes to collection time.

That's no way to run a business.

Id move. F*ck HOA's. When we bought we specifically told our realtor that we dont want to see any HOA areas. The subdivision right across the main road is HOA and our subdivision is just as nice looking. Sure we lack a play ground but so what.

I'd hope that a neighbor would let me know if I was being loud. If I'm watching a movie later at night, I almost always have the remote for my AVR right beside me in case I need to adjust the volume. I think while watching Ip Man 2 last night, I went from about -26 to -37 throughout the movie.
