Hmm, could i be reported to Ebay for doing this?

Alrighty, i was looking through ebay to find what i was planning on selling. It was something relatively small, so i figured that i wouldn't waste my time writing up a description. I decide to copy someone else's description (text only, no html), but i changed the wording in the beginning, and the wording at the end. I also added a bit more info. Now this guy emails me, asks me if i can sell him what i auctioned off, and tells me that he's going to report me to ebay. Can he even report me to ebay? And most importantly, what will ebay do about this?

HUmmm I don't know.

What was the item?

And why does this guy want it.

Sounds like he's trying to black mail you into selling it to him rather than auctioning it off...

There is nothing wrong with doing that as long as....

-you really owned the item your selling, in other words not a scam.
-you should be polite and ask the person you copied from. As long as your not selling a hundred of that item, becoming direct competition i doubt they would mind.

Well, the funny thing is that he messaged me inquiring to buy. It wasn't until about 8 emails later that he says he'd report me.

Well, i didn't ask him for his permission, didn't think someone would get their panties in a bunch. It's not like he eloquently described the friggen product or anything 😛

Hehe, so you don't think ebay can do anything about this? I've been a member for a few years now, and i don't have any negative refs, so i don't think they'd go all out on this one. Anyone think that i should raise the price of what i was planning to sell to that guy? >=)

He's a jackass, you're a jackass, I don't see what the problem is?

Don't steal other people's descriptions, it's happened to me and it pisses me off.

As others have said, ignore him they are trying to blackmail you. If he got bossy i'd report him, sending copies of all the emails.(after you ask that other auction person if they mind you used the description)

eBay should take your side on this since he's trying to scam them out of the sale fee . . .oh, yeah and because he's threatening you.

Copying someone else's text isn't fraudulent if it does match your item too. Copying someone else's photo IS fraud unless you clearly state it's not a photo of the actual item.

Well, like he said, both of you are Jackasses - but I think the other dude is a Jackass AND a bastard, and I htink you can report to Ebay about his emails for blackmailing you. Seriously.

I'd just apologize one time and then start ignoring him.

Look, he really can't do anything to you, but it is bad form to copy any parts of somebody else's auction. Just save the e-mails in case Ebay contacts you.

unless he has something to the effect of.....

"All images and statements contained herein are considered property of seller. Unauthorized use is prohibited without expressed written consent of seller. "

then you're alright.

*shrugs*

i just put it there to keep people from ripping off my html line for line.

it gets annoying when you get messages like "are you selling the same stuff as this person? both listing and pictures are the same." and you find out your work is being used to purport fraud. ever since i did, i havent gotten a message like that, so as far as i'm concerned: blah. not like i would have the time or resources to enforce it anyways...

its like safeharbor. does nothing, just the mere threat of force is enough to keep everything in check.

edit: interesting info though, thanks for the link. i'll have to look that over more carefully in the morning. but look at it from this point of view: would you like to see your work shamelessly ripped off for the profit of someone else?

your not suppose to do it but the guy is making a bigger deal then needed

To report the unauthorized use of your copyrighted image to eBay, go to our Contact Rules & Safety web form and click on: "Questionable Content on eBay", then "Unauthorized use of image, text, or links", and then "Use of Pictures, Text, or Links without permission". You will be provided with an email form, where you can enter the offending item number in the item number box. Be sure to include an item number of one of your listings containing your copyrighted material in the body of the email to us. Please also explain exactly how your rights have been violated.

Remember that you can only report images that you own the copyright to, such as pictures you took yourself. If you obtained the images from the internet, you likely do not have any rights in them.

Hey matt, does this ring a bell?

0100011 00110 111 1011100100 1101 10101 100101 0111001001

10110 00 1111 00 100 10 000 0011 0011 101 101 11101 10011 10110

01010 11001 0 10111 010001 10000 100 1100 010 0 110011

Those jerks that copy descriptions piss me off, I don't see why a fully grown adult can't write his own freaking description. Not only that, but they copy the description that high school student (that's me) wrote! I don't know if it's sad or just them being lazy.
