all she did is defend herself, and she got accused of lying

Why didn't she get Cochrane or somebody else.

I think she deserves jail for picking such a horrible legal defense. She did nothing that nobody else would not have done given the situation. She's a sacrifical lamb, which is not fair.

the reason why the case got so big is just because its martha stewart invovled.. the prosecutors just want to set an example of her by nailing her to the wall..

Imagine this scenario:
you are driving in the freeway and doing 10 over the speed limit. A cop pulled you over, and you said you are going on the speed limit. THIS IS ALSO LYING! and you should also go to jail for it. But do people go to jail for this? NO coz its such a trivial case.
Martha did lie, but she does not deserve to go to jail.

All martha did is defend herself, and yes she did lie, but she did that because she want to defend herself..

The lesson that will be taken from this case is that people will NOT talk to the government regarding ANYTHING, since whatever you say will be used against you..

THERE ARE FAR MORE people that deserve to go to jail. Executives from enron, global crossing, rite aid, etc eliminated MILLIONS of dollars from stakeholders.. and they are not seeing any jail time. They deserve to be punished 10000 times more than martha..

All Martha did is lying to the investigators, and she did nothing else...

but the question is, why are the prosecutors so bent in nailing martha? IMO its just because of her image of perfection, and it creates a BIG material for the media to chew on... and also for the general public

Insider trading is RAMPANT EVERYHWERE.... everyone does insider trading in some sense.. you hear from your family, buy this stock since they just invented something.. that is ALSO insider trading

oh and also the insider trading charge was dropped against Martha, so they only got her for lying..
If she had kept her mouth shut, she would be OK... again the message for the people will be: its better to keep your mouth shut... coz they will nail you if you do talk..

hey I just read that article 10 minutes ago :) sounds like her defense team really sucked. I don't truly think she should go to jail, just pay a big fine. I do like the idea of her in jail tho :p

If Martha should be sent to jail for lying under oath, doesn't former president Clinton deserve some jail time too? Or does that depend on the meaning of the word "the"?

Althought she is guilty it would be horrible and unjust if she ends up in jail. I think its punishment enough that she will never be CEO of her own company and her reputation is tarnished for life.

I am sorry but I think you are totally misunderstanding the law. First off, it is illegal if I lie to an officer and I could go to jail for it. What makes the Martha Stewart case different is that we are talking about a case with far reaching effects. With the Enron, Arthur Andersens, IMClone, WorldCom sleezy executives around nowadays, something as significant as lying about insider trading is not to be taken lightly. Martha's company has a lot of investors, hardworking Americans like you and me. If she lied about IMClone, what makes you think she won't lie and cheat her own shareholders, so she could make a quick buck? People think that whitecolor crime is not bad as physical crime, but I think it's just as bad, if not more. Just because the guy doesn't have a chainsaw and hockey mask on, doesn't mean he is not just as evil.

Lastly, I think it's funny that you think that lying is a standard part of defense. When people talk about the word defend, or to defend oneself, they are talking about offering evidence that you are not guilty. For example - counterarguments, an alibi, documents etc. LYING has NEVER been a legally (or socially acceptable) part of a defense. I don't know if I could make it any more clear.

oh and I also think that this is a perfect example that shows the downside of the american's justice system.

The prosecutors are nailing martha since she is a big fish, and they get major press coverage..

they have much BIGGER stuff to work on, not a case as trivial as this..

Tell that to all the people that lost their pensions and savings because of insdier tradeing and lie's. What she did is minor compared to some others, but that does not mean she does not deserve jail time.
