Help!!! Don't have XP tablet CD to reformat

I purchased a Gateway M275XL from a third party which didnt include any software including Windows XP tablet CD.
The tablet is full of programs and files the first owner use.
The tablet is very slow even though it has 1.6ghz 1mb.
I want to do a fresh format, but no idea how to do it without the xp disc.

doesnt the seller have to legally have to surrender the software since it came with the tablet?

I bought it off ebay and it clearly stated it does not include any software.
I think maybe the seller misplace them or just throw those out with the orgainal box.
The tablet only come with the power supply.

I called, but they told me they cannot send them out 15 days after the puchase.

Err, can you clarify. Did you mean until 15 days after or once past 15 days? I suspect the later and that sounds strange, you can get replacement media from every major vendor. Tablet Edition isn't available retail (just OEM and MSDN). I'd call back and escalate the call to a manager, Gateway shouldn't be leaving you out to dry here (albeit, it shouldn't be free either, should be around $25 or so for media).

The other option would be to find someone with the same machine and get a copy of the media. You should be properly licensed to the hardware, so you would remain legal (IMHO).
