Help! Advice requested: Speeding Ticket

Details:
Cited 80mph in 55mph zone. $139 fine and 4 points added to my license

No previous violations in the past 4-5 years, no points on my license.

I don't care about the fine, but I hope to plea to a lesser charge in order to reduce the number of points on my license to avoid an increase in insurance rates. Even if the judge drops it to 15mph over it's still 3 points. I spoke to a lawyer and he did not recommend involving their office, said that I should represent myself and explain my wish to the judge. What do I say?

what you just wrote, that you are extremely sorry and that you had never done something like this, you were being careless and it will never happen again and if he/she would please reduce the number of points on your license.

Show up to court will almost guarantee a reduction, I've never heard of not getting a reduction. Also you run the chance that the officer wont show in which case the whole citation is thrown out the window and you get off scottfree.

That is uncalled for, don't even reply if you don't have anything productive to say.

Anyways, if you really want to try to beat the ticket, which would lead to no points on your license, go to your local library and see if you can find any books on beating tickets. I saw a special on The Learning Channel and the author of a couple books explained how he has beaten all of his tickets.

You could just do what DAM said and just be really sincere. I hear many times if you go into court and ask for a lesser plea, they will give it to you. Don't forget about court costs.... it is $60 in my area

Good Luck, I got a ticket for 80 in a 55 couple years back ... I feel your pain.

Call the DA for the county you were ticketed in and see if they will reduce the ticket... I got a 52 in a 35 reduced to 42 in a 35. It was my first and only ticket. Got that a little over a year ago while on vacation at the beach. I think I ended up paying $100 for the lowered ticket and didn't have to go to court at all. But if your state is like NC anything over 55 is a little more serious then anything under 55... be glad you still have a license. ;)

/me was caught doing 88 in a 35zone ....it shouldn't have been a 35mph zone :|

I got a lawyer, faught it and got most dropped. fines went from $700+ to $166 and 2 points on the license :D

Lawyer fee was as much as the ticket BUT.... insurance didn't freak out which is what I cared about at the time too, not the huge fine...insurance WOULD have went up like a LOT over the next 3-5 years! phewwww

I called the clerk's office, they told me that the DA wouldn't be involved in my traffic case and I'd have to appear before 'the' judge. I believe traffice violations are the primary source of income for the county so I know having the ticket reduced is a long shot but I'm going to cross my fingers and hope for the best. Anyone here had any luck with having a speeding ticket changed to a non-moving violation?

What do you expect them to do, say "oh, you're not guilty of speeding, but you're guilty of... um... hm.... Hey, you had a taillight out! $100, please."

You will either pay the full fine for speeding, a reduced fine for speeding, or no fine at all. They're not going to fine you for a violation that you're not charged with.

Do exactly what your lawyer advised. Point out to the judge your pristine record and be very apologetic and respectful promise to be more careful in the future and ask to have it reduced. Don't be specific what you want it reduced to let the judge come up with that. if he is a decent judge he may let you walk with a stern warning and no points. Good Luck man.

No offense, but I'm really not looking for opinions, just advice. The citation already told me I did something wrong.

I regularly hear from people that say their ticket was reduced from xx in an xx to yy in a yy, paying a lesser fine and reduced points on the license.

I don't know if it helps to explain any but I was on a motorcycle. Acceleration is a lot more 'instant' than in a automobile.

I guess you didn't understand what I said. You asked if the ticket would be reduced to a non-moving violation. I said no.

80 in a 55 is a moving violation. If it's reduced to 75 in a 65, it's still a moving violation. That's not an opinion.

I understand the difference between a moving and non-moving violation. I also understand that non-moving violations have lesser consequences, and as a result have been used in plea bargain cases to reduce speeding violations. Someone here a while back was bragging about the number of speeding tickets they had received and noted that none were on record as a result of using a lawyer to plea to non-moving violations. I take everything with a grain of salt, however, so I'm asking for additional advice on the matter. I guess I should have narrowed the thread to "If you have been in this situation, what was the result?..."
