Question Heatsink sitting on an angle

Nope, that is definitely not right. Tower heatsinks never sit at an angle like that. It's probably secured but at that angle it wouldn't be making full or proper contact with the cpu.

Never say never... On several Intel boards, I've had to mount my Zalman CNPS5X at an angle such as that, because of the way the mounting hardware works. This is supported, the plastic ring that the heatsink clips to, has angled mounting hooks at an off-axis angle on each side.

So out of the box the hs didnt have the rught mounting for the mb, is this correct?

No, it's not correct.

The mounting mechanism for the heatpipe + fan portion of the heatsink, is two clips, like an AMD AMx heatsink (in fact, it may be exactly that clip mounting specification, as the heatsink is AMx compatible too), that are tightened with screws that adjust the clips inward and upward.

It affixes to clip mounts on a circular plastic base, that has push-pins, and offsets, to mount on 775 or 115x. (Pretty clever, really.)

That circular base, on one axis, has clip mounts on both opposite sides. On the other axis, it has both clip mounts on both sides in the center, and also clip mounts off-axis, both before and after the central ones, allowing you to intentionally mount the heatsink at an angle such as in the OP's picture.

The reason for doing such, is that many Intel boards, have the chokes for the VRMs, right up close to the heatsink area, designed only for the stock Intel heatsink with the push-pins on each corner. Only, this heatsink mounts near the middle, and the chokes are right up against there, such that the metal clips dangling off of the heatsink, with a slight bevel on the bottom, will not fit onto the clip mount, between the mounting ring and the VRM chokes. Just won't. So, the only way around that, is to use the off-axis angled clip mounts.

Yea but this is amd. Im going to guess its not supposed to be mounted off axis and i wouldnt but a pc from someone who had his hs off axis. Not choosing the proper mount or cooler seems like the person is retarded. No way in hell the cpu is getting proper cooling

I've seen a few AMD mounting brackets that use the center strap method, but allow some rotational leeway - up until the heatpipes hit the mounting strap. Plenty of ways to get worse cooling than having the tower cooler at an odd angle.

Humans are coded for symmetry. Not always the best, just look at the organic circuit layouts with automated tools versus manual.
