He said, she said parking lot accidents

I was almost hit by an idiot earlier today in a parking lot. I was about 4 spots over from the exit. I see the minivan clear past me and stop at the exit. As I proceeded to back out the driver suddenly decides he wants to use the exit on the other end of the lot. Without looking he blindly reverses to make a 3 point turn. He did it so fast I didn't even have time to honk but I was able to stop short of his path and avoid a collision.

It was clearly his fault but if it came down to a he said, she said ordeal how would the insurance companies put fault if there are no witnesses? 50/50 and each party just fix their own cars?
 
today i was driving 45 mph down a busy 2 way street. this old with 2 kids is waiting for traffic to clear so she can cross extremely busy street. without warning, dumbass kid ~ 7 years old just tries to dart across without looking both ways. i swerved hard and the kid jumped right back. mom was pissed at kid but my heart dropped. the scene kept replaying overin my head......what if i had hit that kid? i was literally inches away from getting a new paint job. glad i have video cameras mounted to capture these things.

Technically one should slow down and allow for at least 3 or more feet whenever passing a pedestrian where ever they are.

Not necessarily. I had one in the parking lot of school years back. Insurance went after the other driver for the deductable because it was his fault. I did file a report with campus police. It was in MI.
 
At least in kalamazoo, WMU Campus does not = private property. The campus police are real police.

At a grocery store its a whole other story.
