having mouse problems

My mouse sometimes works flawlessly and then sometimes is a pain in the a$$. it becomes jerky and won't respond except when i move it up and down. could this be a software/driver problem? i recently upgraded from linux lindows to windows xp. i downloaded the driver and everything was working fine till my mouse started going crazy. the mouse came w/ the $99 anthlon pc i got at frys. would they let me exchange it or get a new one? tia 🙂
