You do realize without the 14th amendment your state government could decide it doesn't like what you are posting in here and throw you in prison or worst for it. The 14th amendment allows you to say what you say without fear of state government suppression.

You do realize with the 14th amendment your central government could decide it doesn't like what you are posting in here and throw you in prison or worst for it. The 14th amendment bars the state from protecting you against the interest of the central government. I admit and concede entirely that it has been used for good at times, but what about with regards to federal laws that passed 14th amendment due process challenges that restrict liberties that the state government would like its citizens to have?

The Bill of Rights protects us from such things. The 14th extended that protection.

It was, or still could be possible, that a president, congress, and supreme court would be willing to allow a ban on gay marriage and it would pass both bill of rights test and 14th amendment tests. From there EVERY state would be powerless to allow gay marriage.

Obviously a hypothetical but its possible and that is the issue that he is driving at.
