Probably because it's important to be able to carry on the discussion, and it's not in any way being used as a slur.

yes we do.

murder is murder, but there are different types of murders (1st, 2nd, etc) and i consider hate crime murder one of them.

i believe that INTENT is as much part of the crime as the crime itself. so...

being killed for what\who you are is pretty disgusting. i get offended as a human being for the existence of hate crimes.

and hate crimes can be committed on the minorities, as well as you white people. being killed for being white is AS wrong as being killed for being black, pink, purple, yellow, red, lavender, brown, stupid, smart, retarted...

being killed for being racist, i think [should] also fall under the the hate crime laws as well. and no i am no being hypocritical... a human being is a human being. (i have a feeling someone is going to call me a hypocrite for that last part...)

of course i am using killed as a type of hate crime, beatings are another.

Prosecutors try to nail the defendant as hard as they can. Hate crime legislation only raises the limit for them. They will play the hate crime card and try to get a harder sentence whenever they can. For this reason, plus the reasons in the above article, PLUS THE FACT THAT ALL MEN ARE CREATED EQUAL, hate crime legislation needs to be flushed.

Here's a thought...
Let the state prosecutors, prosecute people for ordinary crimes (assault, murder, vanadlism).
Let the federal prosecutors, prosecute the "hate crime" aspect of the crime.
The person wouldn't be on trial for the same thing twice. This would "shake out" much of the "hate crime" debate. That way state courts could get on with the business at hand. Let the Feds get all caught up with the hype over hate crimes.
