no he hasn't, but I am willing to bet he did contact a lawyer over this. The first thing the lawyer would have said (esp in light of the idiot's prank calling and flooding email boxes) is to not post and not talk about it.

I wish the 'kids' didn't get involved....even the lady at mits. corporate said a couple people called screaming stupid stuff about ebay and mark's mits. and hung up.

Whoever wants to help, you can't be convicted or charged with any kind of legal damages if you just 'complain'. If you say Mark's Mits. is a bunch of communists then yeah you could have a problem, but if you just call Mits. or even the dealership and say you don't agree with the practices they have done.

Now that everyone is all worked up in a Tizzy, maybe we should think about the fact that the buyer could be lying because hes pissed at the dealership. It's unlikely, although all you have to do is post some crap on the net and a bijillion assholes start their own vigilante justice by screaming into the phone, sending spam, etc.

Just a thought.......

hmm people keep saying he is making this up, however the Subaru boards know the guy and there is a closed ebay auction as proof.

UPDATE from MarkD

Wow - This thread is amazing.

It seems like the entire world hates car dealers, ebay, and Mark Mitsubishi.

My initial post was not a hoax. I believe it to be 100% accurate. I don't think I have anything significant to add about the factual situation now.

For those wanting to know, I was out of town this weekend. I attended the Wurstfest Festival in New Braunsfels, Texas. I got back very late Sunday and have been reading this thread and individuals emails since then.

I think many readers might be interested in the second and final communication from Mark Mitsubishi to me.

"We reserve the right to cancel all existing bids and end the auction early should the item no longer be available for sale."

This is the exact language that appeared on our e-bay listing,

We did have the right to pull the vehicle from the auction, we did receive a bid on that vehicle from an outside source for $32700, you did have the right to match that bid.

But because you've seemed to become so upset over the situation, we would be willing to sell another brand new Evolution we have on the lot right now for $26995 plus all applicable fees.

You have until 8:00 pm tonight, Oct. 31st to committ to this offer. You can call John Williams at 480-425-XXXX or email us back right away.

************

I'm in the Central Time Zone. Mark Mitsubishi is in the Mountain Time Zone. I have been contacted by the dealer exactly twice. The first email and now the email above. I contacted the dealer by phone prior to the auction and after Mark Mitsubishi backed out of the deal. I emailed Mark Mitsubishi several times. There has been no other communications from Mark Mitsubishi.

I need to catch up (pg 78 now) and determine what should happen next.

Thanks to all for the information, suggestions, comments, effort in my behalf, and support -- truly amazing.

And the Stealership stated they were trying to resolve the situation with him.

Another post from that thread.

Well, I just got off the phone with Mitsubishi and I talked to a nice lady who said that she was a vehicle case manager. As soon as I said "Mark Mitsubishi" she knew exactly what I was talking about. She even went over the story to make sure I didn't have anything to add to previous comments. She said that they were in the process of contacting the owner of the dealership and that they were investigating everything. Her tone of voice clearly told me that Mitsubishi wasn't happy with what is going on down there.

Sweeet :)

*** IT'S OFFICIAL ***

The eBayer, MarkD, gets the car! The dealership had posted a reply to the negative feedback left on eBay saying that they will make good on the offer, and MarkD himself just confirmed this on the nasioc forums! He gets the exact car for the exact price that he wont it at!

His last post...

Sorry for the delay in posting - I was working late.

It's true.

MARK MITSUBISHI offered me the same ebay EVO at the final auction price.

Many of you knew of MARK MITSUBISHI's offer before I did since I was at work.

I was informed that the car was not titled and the full factory warranty would be in effect.

The finance manager did not know the exact mileage, but he informed me that the car remained at MARK MITSUBISHI after the auction.

The dealer is researching tax issues for a out of state sale.

This thread is amazing. Thanks to all.

LOL!! Very, very nice! all around!

Yes, it was a Right Place, Right Time sort of thing and the abuse that inspried it will likely go on tomorrow just as it did before. Still, it's nice to see that the internet community really can come together, and it's wonderful to see how effective it can be when Headquarters lights a fire under the butt of those in the field. Damn, the sh!t must have really rolled down the ranks fast and furious over at Mitsu to get that kind of turn around so quick.

Now... who wants to lay some $$ that they're going to try and rope him in with some kind of extra legal agreements regarding this whole debacle?

Imagine if you are that vechile case manager lady and you get to call up Mark and tell him how it is. I'm sure the conversation went something like "listen Mark I really don't give a @$#% if your to stupid to follow your own legal disclaimer or to set a reserve on the bidding. Your giving this guy the car and I don't care how much money your going to lose." That job would be awesome.

thats great, but maybe if he held his ground and didn't accept marks offer out of principle, maybe mitsu will give him a car for free to avoid furthur tarnishment of their rep and maybe a public statement that mark mitsu will be punished or whatever.

He's already getting a $40,000 car for ~$26,000... Even with all the hassle, it was still worth it, or at least it would be worth it to me. $14,000 isn't something to shake a stick at when you make what I make =)

He should park it in a lot across the street from the dealership with a huge FOR SALE sign in the windows.

One, he'd make a nice profit, and two, it would just piss them off sooooo much  :D.
