Guy trying to sell Dell OS DVD's, thinks its legal

right, we do this too esp for people that have a PC die and their key is no longer working.

We then know that key is now 'used' and remove the sticker.

it's a whole different ball game if I were to go pull a key and find out it's been activated along with the rest of my inventory.

Yep, thats exactly how my work runs things. Every new PC we get in comes with Vista. But we don't use Vista. We toss everything it comes with including the restore DVD and OS DVD. We are still running XP. You don't see us selling those DVD's. Why? Because its friggin illegal.

let me be a devil's advocate.... how is it illegal?

it really isn't piracy. it is an original disc.

unless the guy is selling the key that comes with it, (which maybe stealing company's property)

even if the dvd says only to be distribute with dell pc, that's just breaking dell's EULA...

Well, it's definitely not piracy. I'm not sure who brought that up? I'm referring to him selling the DVD's AND the key's, which he is doing. From what I understand, that is illegal.

On a OEM copy it is illegal. Once the operating has been installed on the system, it is tied to the system and can not be unbound. It doesn't matter if you uninstall the OEM copy and remove the product key sticker from the box. Since these systems ship with the operating system installed from the factory, that copy is bound to them.

Retail versions, it is legal to remove from your PC and sell as long as you sell both the copy and the key after complete removal from your system.
 
The EULA usually states it's only good on Dell machines...not just the machine you bought. Being DELL is pretty popular out there there is no proof he is not selling to Dell users only.

I still think his behavior falls under unethical for one, and more than likely illegal due to stealing keys paid for by his company.

All that said most pro's don't really understand licensing.

How about this... who the fuck cares? If you have a moral concern about what's going on, pull your balls out of your mom's purse and make a call to Microsoft/Dell and the forum he posted on then let them handle it. You "need back up"- to confront some guy on the internet with message posts, seriously? What kind of e-peen crusade are you on that makes it necessary to waste everyone's time and bandwith with some sort of grade school tattle-tattle pissing match using Digg and this forum?

The software won't install on any PC that doesn't have DELL configured in the BIOS "Manufacturer" tag anyway. And honestly, anyone who buys a "white van" version of Windows Vista from some guy on the internet with a COA peeled from another PC and "for use in a Dell PC only' printed on the DVD for $60 deserves to get ripped off. It's just like the guy who bought those "Clipsh" speakers off the back of the truck at the local BP station and can't figure out why his woofers look like used sanitary napkins.

Why do you feel the need to correct this guy? I just don't understand why you are expending so much effort on something that doesn't impact you at all? Just leave it alone and let the guy find out the hard way.
