Guy threatened to call the police on me...

Ok, so as most of you have seen me post, I recently got a palm treo. I bought it from a guy who said he owns a business selling these palms, and he's a palm reseller. I paid this guy $440 for a brand new sealed in box palm treo 600GSM Factory unlocked, no logo...

When sending the guy his paypal payment, i put in the note section a little blurb just confirming that the treo was in fact new and sealed in factory box; he accepted the payment. The guy wouldn't ship the treo for like 2 weeks, kept telling me he shipped it, but wouldn't give me the tracking number. Finally 2 weeks later, he gives it to me and it was shipped the day he gave it to me (2 weeks after purchase). I recieve the phone in about 3 days after shipment, and it's used, packaged in ripped up cardboard and tape (not the box, just wrapped up cardboard around the phone and duct taped it together). No usb cable, and the phone is used, beaten up, and scratched up. I call him up and ask him what the hell is going on. He says that he "mistaked" the used phone for the new one.

He told me to send it back for a replacement, but i didn't trust him anymore, so asked him to send me a refund, and as soon as i get the refund, i'll send the phone back. He refused, and told me to call palm, and lie to them, telling them the screen doesn't turn on (which it did), and getting a replacement phone for free.

I call palm to check the status of the warranty, and they tell me the phone was bought in December 2003!! and they say they have no record of him being a reseller of theirs.

So i call the credit card company and file a complaint. They tell me to keep the phone while they do further investigation. The guy keeps emailing me telling me to return the phone, and i tell him that the credit card company told me not to mail it back until they tell me to.

Today he emails me and tells me this:
i recieved the chargeback now I expect the merchadise back immeiately

I tell him i can't mail it back until the credit card company tells me to, and if he has any further questions/comments to call the credit card company himself rather than yelling at me about it.

So he replied with this:

Email me your phone number asap otherwiose I will be calling the police since you have commited a crime of stealing merchandise as well as mail fraud..you have my product and I the money and I am not going to take a loss and resell it when you deciede to send it back and its worthless..understand..Otherwise I will contact paypal with the tracking number and they will void your chargeback..This is not a joke..You will be paying fdor damages when the product goes down in value..Now send it back immediately or I will file the necessary paperwork..

Should I be worried about him calling the cops and him having something on me? I appreciate if you read this. 🙂

EDIT: I forgot to say that when i told him his lying to palm idea didn't work, he said something like this to me on the phone:
It didn't work?? sh!t. Ok, how about this, I'll do it for you...just give me your name, address, and credit card number, and i'll have them ship you out a new one free of charge

Do what the credit card company tells you to do, they deal with this all of the time. The guy probably knows what's going to happen so he's just trying to scare you. Listen to the card company and do exactly what they tell you to do.
 
Have you thought about calling your credit card company?
Is it considered mail fraud to lie about the condition of products?
 
LOL, yeah like paypal can reverse a credit card chargeback. hahaha. that guy is a moron. don't send hin sh1t. tell him to go fvck himself.
 
Tell him to go ahead and call the cops, and remind him he frauded you via postal mail; which is a federal, pound-me-in-the-@ss, prision crime.

edit: in fact, why don't you contact the post master? And keep the phone, consider it a prize for dealing with this jackhole. -IF- the CC company tells you to send it back, do so, 2 weeks later, and make sure it's in the "same" condition. 😉

i'm pretty sure it is. well, lying is an element of fraud... but it isn't fraud with just a lie.

If he is in fact stupid enough to call the police, they will be happy to forward his claims on to the USPS Postal FRAUD inspectors asnd they will hapopily arrest him.
Don't worry about it.

WTF!? I just called the credit card company here is how the conversatio went:

REP: Hello, how may I help you?
Me: Hi, I have a case #, would you like it? It's about a cellular phone where i paid for a new phone, but got a beaten up used one
REP: No, i don't need the case number, what do you need to ask?
Me: Ok, well basically I paid for a brand new cell phone, and the guy ships me a used one. I called mastercard, and they gave me a case number. Well, i just got an email from the guy and this is what it said <read her the email>. Then I replied to him telling him "i can not ship the item back until the credit card company tells me to. they have told me to hold onto it for now for investigative purposes, and they will call me and tell me when to ship it back to you, if you have any questions/concerns, please contact the credit card company about it".
REP: Let me stop you right there sir, you are wrong!
Me: How am I wrong, i was doing EXACTLY as you told me to do.
REP: NO, if you do not ship it back to him, you may lose the claim, ship it back as soon as possible!! We can't tell you not to ship it back to him, it's his and you must ship it back ASAP. I don't know who told you not to ship it back.
Me: I don't know who told me, but it was a person who picked up last time i called this number. I was simply doing EVERYTHING they told me to do EXACTLY how they told me to do it. Would you like the case number so you can take a look yourself who it was and what they told me?
REP: NO, ship it back now.
Me: Ok, thanks.

Me: No thanks, bye

Called the police, they didn't want to hear the story and just said if he calls the cops, then the cops will call me to dispute it. That's all they said and didn't want to hear the story.

welcome to the wonderful world of dealing with the police. if you have something you need from them, forget about it. they're too busy writing tickets, tasering kids, and whining to their union about civilian oversight to help you.
