I never said it was right, and I can't stand shady business practices by dealers. However, there is more than enough easily-accessible information on this dealer that it should've been a no-go from the beginning. People sniff out deals but never wonder why they're so good.

Dealership cannot get him the car as they described.

I'd have to agree with angry hampster here - I think it's common knowledge that in the used car market, you need to be extra, extra cautious just as a given. Personally, I've had enough dealings with car salespeople to stick with my basic rule for that type: assume they're lying until the evidence overwhelmingly establishes otherwise. I'm not saying the dealership's action was right, because it was neither ethical nor legal, but the consumer here failed to practice due diligence also.

This is what it comes down to. The item was not as described. That should be reason enough to refund a deposit.
