He should not be treated any differently than any other citizen would be. And, for any other citizen, "oh, my bad I forgot" would not be an excuse. If it's illegal for me, it's illegal for him too.

The very first comment in the article says it also:

I carried a pistol daily as a state trooper for 26 years, and have carried one daily since retirement (concealed carry permit) and I have never in over 30 years forgot I was carrying a pistol. If you are carrying and forget you are carrying a weapon, then you need to surrender your permit due to being incompetent.

Ferguson, 52, told WGRZ-TV that he frequently carries the gun, for which he has a permit, and did not realize he had it on him when he went to the school as part of the mentoring program.

Back when I worked retail I saw a guy walking around the store with a gun sticking out of the back of his pants. I informed the manager who called the police. The guy turned out to be an off duty cop and said he forgot it was there, and apologized.

Dumbass.

:whiste: If he were a good old boy going to pick up from school one of his litter and forgot he was in possession the responses would differ great amounts and some would be setting up websites to donate money to his fund. Don't kid anyone. I think I said support of your second amendment rights were selective you really showed me to be wrong. Him being a hypocrite type should not drop your support of the right to begin with.

Seriously.

If you "forget" that you have a gun on you, you are not responsible enough to own a gun. And to be honest, you are a danger to those around you.

My feelings exactly. And I don't care what political party you belong to.

He should welcome the process and point out to others that "forgetting" is no excuse. When I carry there isnt a chance in hell I could forget there is a cold chunk of metal pressing at my back. Every move reminds me of exactly where it is. There have been times I have forgotten to grab it when I leave the house, but NEVER have I forgotten I have it on me.

Especially if there are a hundred cops, including a SWAT team in the building your are in, looking for a man with a gun.

His story sucks. He sucks. He needs to go spend some time in prison.

Ferguson often carries a gun during the course of his business day, Giles and Johnson said.
“Mental lapses happen,” Giles said. “Things happen. It’s an unfortunate mistake. Dwayne was not conscious that he was in school with a gun.”

This man is clearly a moron.

Why push for gun control, when you yourself are violating the very thing you want enforced??

I think it's hilarious that a guy pushing for gun control would carry. I could see maybe owning one for home protection...But most people who push for gun control are gun haters and would most likely never spend the hundreds of dollars to own one.

Oh, he should also go to jail like the rest of us would.

I hope the story stays in the forefront because our justice system often works in slow motion. It will be interesting to see if de Blasio gets involved.

Harvey Austin Elementary School is in Buffalo. The mayor of Buffalo is Byron Brown.

Why would the mayor of Manhattan be involved with a situation that occured in Buffalo?

I think they should let him plead to a misdemeanor. It seems like a stupid mistake. But I think we hand out felonies too freely in general.

He lobbied for the SAFE act in NYS... Which bumped possession of a firearm from misdemeanor to felony status.

Let him reap what he has sown.

So Americans are not for 2nd amendment rights any more? Why does your stance change on a issue because of the person it was applied to? Very odd supportive behaviour.

Look. While I think I should be allowed to carry concealed even at my child's school, I can't support ANYONE who does so when it is and has been against the law nationally for so long. I've been through four CCW classes as I've moved state to state over the last 15 years and every one (included my CCW class in NYS) covered the nuances of public/private property as well schools and gov't facilities.

If you can't stay in between those lines, you make all CCW holders look bad. He KNEW the law... He claims he forgot he was carrying yet he claims he wasn't aware of the illegality of having a firearm on school grounds...When he lobbied for a provision in the safe act to move that offense to a felony from misdemeanor.

Those very facts, and the fact that he actually has the gall to plead not guilty means he will get no support from any 2nd amendment supporter.

The fact that he is a gun control advocate, yet carries concealed, yet broke the law, and then pleads "not guilty" is pretty much as big of a fucking asshole as you can get.
