On my phone so I'll just cliff note this

In the middle of a refi
Underwriting said app looks good but they. Want a letter of explanation regarding a collections on my credit history

Collection is from an apt complex I left before buying my house
They claim I didnt give enough notice and there was carpet dmg
Both are lies of course.
Went through the whole shebang about validating the debt and they couldn't do so.
They still put a hit on my credit history which I just ignored because it didn't affect my previous refi or any other credit issues.

My question is, how should I explain the mark? Just state what I put here in this thread or are there certain things I need to avoid saying so the refi doesn't fail? The initial loan officer asked about It too and when I explained it to him, he called it a grudge payment when I said I won't pay it out of principle

First thing is to write a letter of dispute to the credit bureau.

As for the loan right now all you can do is explain. But get the letter in to any and all bureaus it's on.
 
Ahh the old damaged carpet BS that apartments try to screw people on. They use the cheapest carpets because they budget on replacing the carpet whenever someone moves out anyways.
I've had an apartment complex try that on me when I rented and I told them to screw off and reminded the lady in the office that she told me when we rented the place that they change the carpet after every renter regardless of the condition.
 
Also why, if you're giving notice, it's a good idea to do it in writing, print out two copies of it, and make them sign your copy, saying they received their own copy. Nothing stifles a "we never got it" or "we got it too late" complaint faster!
 
All apartment complexes are scams and the people who run them are fucking criminals.

Do you know the age of the carpet when you moved in and is there a signed move in inspection noting condition? Things like carpets are depreciated over time. Usually around ten years for well maintained apartment grade carpet. If they are trying to get full replacement cost it would never hold up anyway, not that this is an active civil claim.

Always take pictures when you move in and have them signed and attached to any inspection. Same on the way out.

The carpet was new when we moved in but we lived there for 2.5 years. They claim that a small section in the hallway needed to be replaced and they wanted $1100 for it. I priced out apartment grade carpet + installation at home depot for that size apt and they quoted me ~$800 for the whole apt.
 
One last thing on the proof of indebtedness. Send a registered letter to the agency demanding proof of indebtedness. Also demand they remove it from your report in the absence of same. Copy it to your states regulatory agency (sorry Canadian, ours is the consumer protection branch).

Edit. Also add your previous attempts to establish proof and their inaction. I'd even cite that as reason to remove it immediately from your report.
