so i have a lease until june 2006. i bought a house in december of 2005. i moved out of the apartment and into my house knowing full well that i would probably have to pay the apartment rent until the end of my lease.

fine, i can deal with that.

now the apartment management people are giving me a hard time saying i broke my lease, i'm going to have to pay penalties, yadda yadda yadda.


WTF, how did i fvcking break my lease if i'm still making my damn payments?

i feel like just saying fvck them and stop paying, wtf are they going to do kick me out of the apartment?

stupid fvcks. treat people with some damn courtesy.

god damn fvcking @ssholes.

 
as long as you are still paying them you didnt break anything i highly doubt in the agreement there is a clause that says that someone has to be physicially living there as well

Happened to a friend of mine too, either get a lawyer or pay the fine. Apartment owners are all about making money, no matter how shady.

here is their idea of fine, i pay rent until they get someone in the apartment then i have to pay them an additional $400.00.

up to that, i was agreeable, but them treating my like a second class citizen is just unacceptable.

The move in some stuff, break the toilet and hot water heater. Demand its fixed. If it isn't, hire the most expensive guy to fix it and deduct it from the rent payments. Then break it again.

exactly, they have keys anyway. all apartment management keeps a copy of the apartment key in the maintenance office. so they would have access anyway.

they were claiming that they couldn't show it unless they had my keys, which is ultimate bs, but i was in the middle of moving to my new house, closing on the house and all the sh1t involved with moving including changing my auto insurance etc because we moved across the border to PA.

so when they asked for it, i really didn't think it thru.

i'm going to call them this afternoon and really let them have it.

god they are the worst scum on the face of the earth.
 
Tell them to mail you written proof from the contract stating where you broke the terms of the agreement.

Wait and see what they say.

it's stupid on their part, basically they are pushing me to do that, altho that wasn't how i wanted to do this.

not exactly true. i had a client who owned about 130 homes all across philadelphia and he was a very good guy. he was honest and he made every effort to treat people fairly.

but i believe he was the exception.

 
I'm really confused. You gave them back your keys while the apartment is still yours? And they're showing your apartment to other tenants? If they rent it, does that get you out of paying for the rest of the lease? That's the only reason I can see for doing that.

I don't think you've said yet what they say you're doing to break the lease, have you?
 
Why the hell would you allow them to show your appartment? Get the keys, go back and make the place unshowable w/o damaging anything. You know they are, in general (local laws vary), supposed to rent your place FIRST to let you out of the lease. IE they try and show your place until someone rents.

If they are showing your place, and renting out others because you are already paying for that one, they may have put themselves in a real spot, legally.

ya, the idea is, they can show my apartment now that i'm out, if they lease it to someone else, i no longer have to pay, i do however have to pay a $400.00 fine.

again, i haven't actually broken the lease because i am still making lease payments.

it's weird, it seems that this would be preferable to them then having me live out my lease then turn over the keys to them at which point they have a gap where they don't receive payment.

instead, they get a 6 month window to lease this out while still getting money from me AND being able to show it, and so this, to them makes me the bad guy.

that's what pisses me off so much. is that they get the better end of the deal by me moving out and they STILL insist on treating me like a second class citizen.

that's just STUPID on their part.

i'll check and see the laws on that. that may be why they are giving me such a stink right now, they probably want to lease out other properties first and are going to keep me as status unknown as long as they can.

hence everytime i call they give me the run around.
 
go get your keys back, for all you know someoen might already be livign there and you are paying rent on it still...
