Cliff Notes on bottom :

My older brother did a year at law school. He met a Chinese woman originally from China.

To make a long story short, they started dating 2nd semester and ended up getting married a few days ago. I will spare all the weirdness and try to make this a combination of cliff notes and a story.

Anyways, the mother comes from china earlier in the week. At this point they are only engaged wanting to get married. My older brother did not want to continue law school and secured a well paying job and his own place far from law school near where we live.

If they were to get married, the girl agreed to transfer law school and finish up locally, while living at the new place. Fine, older brother is 23 years old and can make his own decisions. The family was very wary as they had only been dating since January.

The mother comes down, and the girl makes it apparent that she will not be transferring law schools and will finish it 500 miles away. Fine everyone thinks. This is probably the best choice for her. But at this point there is really no point in getting married. If you live 500 miles away and will only be spending like 4 weeks a year together, there is really no point in getting married.

My parents express that marriage would be unacceptable if they did not live together. My brother and the girl agree with this. We will just date they say. The girl was supposed to spend the rest of the summer at our home at this point.

The mother is here and they head up to NY 2 days in a row. Fine, she s from China and seeing the greatest city in the world is understandable. This is where it gets weird. My brother and this girl elope. They head to the chinese embassy, get all info in, and get married in NY.

The day after getting married she informs everyone that she will not be spending any more time here and will tour a bit with her mother and head back to law school. On the night of marriage there is no consumation. And the girl starts getting very cold to my brother.

2 days after the marriage, when she informs us she is leaving, we ask for the marriage certificate. She refuses to give us either the certificate or a copy of it. Eventually we had to threaten to call the police to get a copy of the certificate.

It occurs to my brother that he does not have his passport. We check all around and it is not there. We ask the Chinese woman if she has it. She says no she does not. We then request that she check her bags to make sure, (in front of us). She refuses. We say that we will not be giving them a ride to the train station, unless she checks her belongings for it in front of us. She refuses again. We wait. She checks her belongings, and it is there, contrary to what she said. (It was in one of her small bags..this is important because when we were packing the car up, we tried to move it to make room for other bags. When anyone but her touched it, she flipped out.)

This is the part where I need the tech knowledge opinions of anandtech. She secretly packed away my brother's laptop in her belongings. We asked her if she had it. Again, she said no. We sent our youngest brother (bar fighter / bouncer / bodybuilder) to check her belongings for it. It is neatly stowed away in her belongings. He removes it, and we inform her that we have his laptop and that she will not be taking it with her, because well, its fvcken ours.

At this point, the Chinese girl flips and demands to take it, she has important information on it. But, well, bar fighter has it, and ain t no one taking it from him, unless they are packing heat.

Basically, now, it is very apparent that this marriage wasnt, really real. We will begin steps to get an anullment soon. But my family wants me to take the laptop and see what the hell is on there, that is so important.

Basically, I will install norton ghost, and ghost the hard drive to CD's then I will begin snooping around. Is there a good freeware program to aid me in this ?

Also, can anyone offer any legal advice on the anullment process or any advice on what we should be watching out for legally? The entire family is lawyers, and we have no lawyers in the family.

Thoughts?

Cliff notes:

1.) Brother got married to chinese woman he knew for 6 months.
2.) Chinese woman lied to him about post-marriage arrangements
3.) Chinese woman lied about possessing brother's visa, marriage certificate, and brother's laptop
4.) We took back all 3 of these.
5.) Need computer advice on how to find what she was protecting on brothers laptop, need legal advice on getting her ass deported and marriage anulled.
6.) Brother got 0wned.

Call INS and explain it all to them. They can tell you what the best course of action is if any. If they determine the marraige was nothing but a sham to gain legal immigration status I am pretty sure they can revoke her visa and show her the door. Of course since she is already here they could fight it in court forever seemingly. I would also have your brother keep a close eye on his credit report. She probably got all the important stuff like his SS# and with that marraige cert I would imagine she could really screw with his credit.

Definetly contact INS. Sounds like a marriage scam. She married your brother to gain residency/citizenship whatever. They can investigate and deport her ass in no time.

you could just lock her in a closet or the basement or something or you could try selling her to some sweatshop, that would teach her.

INS....INS all the way

as a permanent resident in the US (non citizen) i would highly recommend that you make the chinese boarding party aware that you will be contacting INS. Not only they can get those people deported, you will be barred from the US for 10 years (no visa or right of entry).

Make it obvious to them that it's either anullment or anullment + deportation + stamp in the passport for 10 years

...Anullment is def. something you wanna do right away

As others have said, contact everybody you need to, to clamp down on your identity. It will be a PITA while you get things worked out, but make sure you're called anytime anybody does anything with your credit, to verify that it was you.

Oh, I guess I misread. When he says "The mother", for some reason I read it as the Chinese woman's mother.. LOL.

ASAP find a lawyer that you trust. Explain the situation to them and ask how you should proceed. It will be well worth whatever it costs.

personally I do not think that INS will do anything, once your are on American soil illegal or not you have options and can play the game.

Of course they can add her to the lists of 100,000+ just like her, but they sure do not have the personel to search for and then deport her.

I would try to get marriage anulled, call INS and then get on with life.....

whew, for one second i thought you were generalizing there ;)
i think 'the mother' was her mother though.

anyway, i think everybody have made the right suggestion here with calling INS, but i doubt they would react to it quickly. your brother's first priority is to get a lawyer, get this marriage annulled, and go from there.

as far as software, i wish i can help with a software, but even without any software, you can copy everything to a networked computer. use xcopy /e /c /h /o from the command prompt to copy everything (you might want to see the xcopy help to make sure what you really want to copy). good luck.

Geez, i really hate people like this. If you ever read minority newspapers, all the personal ads basically require the bride/groom to be a citizen.

It's sick. deport her ass.
